Penyelesaian Terbaik Kemelut Politk Perak -Ust Haron Din
- Bagi tokoh agama yang terkenal, Dato' Dr Haron Din menasihatkan agar kemelut yang berlaku di Perak ini diselesaikan dengan cara paling baik iaitu mengembalikan kuasa kepada rakyat untuk membuat keputusan melalui pilihan raya seluruh negeri.
Timbalan Mursyidul Am PAS itu juga berpendapat, perselisihan tafsiran undang-undang di antara Sultan Perak, Raja Azlan Shah dan Menteri Besar Perak Dato' Seri Nizar Jamaluddin merupakan proses biasa dalam amalam demokrasi, dan bukan kali pertama berlaku di Malaysia dan mana-mana negara di dunia.
"Nizar tidak meletakkan jawatan kerana dia memegang amanah rakyat, dia hendak kembalikan semula kepada rakyat. Itu tafsirannnya.Saya tidak nafikan Tuanku Sultan ada tafsirannya. Jadi jika ada perselisihan tafsiran undang-undang, maka saya tidak fikir itu boleh dinamakan sebagai derhaka.
"Ini sepatutnya diselesaikan dengan cara paling baik iaitu, kembalikan kepada rakyat. Biar rakyat yang menentukan. Atau kita berlapang dada dan bersabar sedikit, biar Mahkamah Tinggi memutuskan kesahihan pelantikan menteri besar kedua," katanya dalam satu wawancara eksklusif dengan Harakah baru-baru ini.
Dalam pada itu beliau menegaskan Raja-raja Malaysia perlu dikekalkan pada takhta yang sedia ada dan rakyat diseru supaya bersatu dan mengekalkan kedudukan mereka.
Beliau antara ulama yang dekat dan rapat hubungannya dengan istana menjelaskan istilah 'sembah derhaka' yang dimanipulasi oleh plebagai pihak khusunya media sedangkan ianya bukan satu bentuk tindakan derhaka yang sebenarnya.
"Sembah derhaka' bermaksud apa yang diminta oleh seorang Raja atau Sultan tidak dapat dipenuhi atau ditunaikan oleh seorang hamba rakyat. Sama ada kecil atau yang besar. Seorang rakyat akan menuturkan bahawa 'patik sembah derhaka'. Bukan yang kita fahami itu derhaka adalah melawan atau menyakiti Raja," katanya yang cuba membandingkan pelbagai perbuatan menderhaka yang dilakukan oleh pemimpin sebelum ini.
Katanya, yang tidak mahu mendedahkan secara terperinci, memang berlaku perbuatan menderhaka yang tidak diketahui umum.
"Ada pemimpin disuruh Raja untuk 'briefing' pada hari tertentu tentang perkembangan negeri, langsung tak datang. Ada yang Raja suruh buat projek untuk rakyat, tetapi pemimpin tak buat. Ada Sultan yang suruh hentikan projek tertentu kerana membazir, mereka terus buat.
"Ada raja suruh bantu ekonomi orang Melayu, dengan bantu projek tertentu tetapi beri pada kroni mereka pula malah ada Raja beritahu saya, ada pemimpin yang terajang pintu istana kerana tidak puas hati.
"Ini semua saya dapat tahu dan ada antara Raja-raja yang beritahu sendiri kepada saya. Inilah perangai mereka... ini jauh lebih derhaka lagi," katanya.

KENYATAAN MEDIA DSAI MENGENAI ELIZABETH WONG

Siasatan Boros Wang RM 26.6 juta

Siasatan Pemborosan wang rakyat sebanyak RM 26.6 juta dalam 2 bulan pertama tahun 2008.

Beberapa bulan yang lalu jawatankuasa pilihan khas Dewan Undangan Negeri (DUN) Selangor telah dilaporkan sedang menyiasat pemborosan semua wakil rakyat BN sebanyak RM 26.6 juta dalam tempoh dua bulan pertama tahun 2008.
Menurut seorang anggota Jawatankuasa Pilihan Khas Mengenai Keupayaan, Kebertanggungjawaban dan Ketelusan (Selcat), siasatan terhadap perbelanjaan besar ini antara dua kes yang dijalankan olehnya.
Satu lagi kes, yang sudah siap siasatan awal, melibatkan sumbangan jutaan ringgit kepada Badan Amal dan Kebajikan Isteri-isteri Selangor (Balkis) yang disalurkan oleh enam syarikat berkaitan kerajaan (GLC) negeri sejak penubuhannya pada 1985.
Satu lagi kes, yang sudah siap siasatan awal, melibatkan sumbangan jutaan ringgit kepada Badan Amal dan Kebajikan Isteri-isteri Selangor (Balkis) yang disalurkan oleh enam syarikat berkaitan kerajaan (GLC) negeri sejak penubuhannya pada 1985.
Menurut YB Haniza Talha, salah seorang Exco kerajaan Selangor, jawatankuasa khas itu masih lagi menyiasat penggunaan RM26,634,844 juta atau 90.6 peratus peruntukan untuk wakil rakyat di negeri itu menjelang pilihanraya umum Mac tahun 2008.
Siasatan itu mengambil masa kerana membabitkan 56 Ahli Dewan Undangan Negeri (Adun) BN sesi lepas, tambahnya.

Selcat dibentuk oleh DUN Selangor tidak lama selepas Pakatan Rakyat mengambil alih pentadbiran negeri, antaranya untuk menyiasat kes pemborosan ini.
Dalam persidangan pertama dewan itu Mei 2008, Menteri Besar Tan Sri Abdul Khalid Ibrahim mendedahkan butiran pemborosan tersebut (lihat carta di atas) yang ditegur oleh Sultan Selangor, Sultan Sharafuddin Idris Shah sewaktu majlis perasmian.
Peruntukan sebanyak RM500,000 bagi seorang wakil rakyat hanya berbaki RM2.9 juta sewaktu kerajaan Pakatan Rakyat mengambil alih pentadbiran negeri, katanya.
Abdul Khalid dilaporkan berkata, Speaker DUN lalu Tan Sri Onn Ismail yang bukannya seorang wakil rakyat BN sesi lepas turut membelanjakan RM600,000.
Jawatankuasa khas Selcat bertujuan memantau selia dan memeriksa kecekapan, kebertanggungjawaban dan ketelusan dalam pentadbiran kerajaan Selangor.
Speaker DUN Teng Chang Khim bertindak sebagai pengerusi badan itu.
Selain Haniza, jawatankuasa itu dianggotai lima lagi ahli DUN – Mohamed Azmin Ali (PKR-Bukit Antarabangsa), Saari Sungib (PAS-Hulu Kelang), Edward Lee Poh Lin (DAP-Bukit Gasing), Sulaiman Abdul Razak (BN-Permatang) dan Ismail Sani (BN-Dusun Tua).

DSAI - Jangan Cemarkan Sistem Raja Berpelembagaan
Ketua Umum - UMNO Jangan Cemarkan Sistem Raja Berpelembagaan
Sekonyong-konyong saya dipersalahkan serta dituduh bertindak dengan tidak menurut lunas-lunas Perlembagaan oleh Pak Lah di atas apa yang berlaku di Perak. YAB Perdana Menteri sewajarnya mengetahui yang sengaja membelakangkan kehendak Perlembagaan Persekutuan serta Undang-Undang Tubuh Negeri Perak ialah timbalan beliau Dato’ Seri Najib Razak. Namun ingatan Pak Lah yang pendek itu bolehlah difahami kerana kita mengetahui reputasi beliau sewaktu mengendalikan mesyuarat.
Sayugia diingatkan tindakan Dato Najib yang cuba menjatuhkan pentadbiran Menteri Besar
Perak Dato’ Seri Nizar dengan cara mengugut, merasuah serta bermain silap mata dengan menghilangkan individu tertentu, sebenarnya mengenepikan Perlembagaan, juga dengan sengaja mencemar kemulian, bukan sahaja Paduka Sri Sultan Perak, malah Institusi Raja-Raja Melayu itu sendiri, kerna mereka adalah Penjaga kepada Sistem Raja Berperlembagaan dan Demokrasi di negara ini.
Makanya tindakan Pakatan Rakyat menyaman YB Zambry menunjukkan komitmen kami di dalam memulihkan kembali penjalanan proses demokrasi di Negeri Perak serta memastikan institusi Raja, tidak dicemar dengan tindakan segelintir yang berpolitik menurut mazhab Machiavelli.

Takziah- Anak Almarhom Dato Sheikh Azmi Meninggal Dunia
Alfatihah- Allahyarham Badrul Zamani bin Dato' Sheikh Azmi
Anak kepada Almarhom Dato' Sheikh Azmi Ahmad telah kembali ke rahmatullah pada hari Sabtu 14 Febuari, jam 8.25 malam di Pusat Perubatan Universiti Malaya UMMC.
Allahyarham berumur 33 tahun dan jenazah Allahyarham telah selamat disempurnakan oleh AJK MAsjid TTDI Jaya Shah Alam dan telah selamat dikebumikan di Tanah Perkuburan Islam Sek 21 Shah Alam pada pagi 25 hb Febuari 2009. YB Yaakob Sapari, ADUN Kota Anggerik turut hadir ke tanah perkuburan bagi mengucapkan takziah kepada keluarga Allahyarham.
Terima kasih kepada Kak Wan, Tn Haji Anuar Salleh, kariah Masjid TTDI Jaya dan mereka mereka yang lain kerana banyak membantu dalam urusan pengendalian jenazah. Hanya Allah swt. jua yang dapat membalas khidmat ikhlas mereka

Apa Kata Ku Li Tentang Perak
Status Menteri Besar Perak - Oleh Tengku Razaleigh
Perlembagaan adalah undang-undang tertinggi di negara ini. Ia merupakan asas dan sumber kepada kuasa undang-undang, dan Raja-Raja telah bersumpah untuk mempertahankannya.
Menurut Perlembagaan, Dato' Seri Mohammad Nizar Jamaluddin adalah Menteri Besar sehinggalah beliau meletak jawatan atas kerelaannya, atau disingkirkan melalui undi tidak percaya menerusi persidangan dewan undangan negeri. Perlembagaan tidak mempunyai sebarang peruntukan untuk menyingkirkannya melalui cara lain, termasuk melalui petisyen atau arahan daripada mana-mana pihak berkuasa.
Dua prinsip perlu dijelaskan:
Pertama, kerajaan yang memerintah diasaskan menurut undang-undang dan prinsip yang terdapat dalam Perlembagaan. Inilah yang membezakan di antara kerajaan yang dibentuk secara sah dan yang dibentuk secara kekerasan melalui undang-undang rimba.
Kedua, kerajaan yang dibentuk secara sah menurut Perlembagaan memperolehi kuasanya daripada mandat yang diberikan rakyat, hanya melalui cara itu. Mandat diberikan oleh rakyat kerana kerajaan itu dibentuk menurut Perlembagaan, dan pemimpin-pemimpinnya mereka pilih melalui pilihan raya yang bebas dan adil.
Kita perlu menguji mandat ini secara berkala. Pada waktu-waktu penting seperti apabila sesebuah kerajaan akan dibentuk atau dibubarkan, Perlembagaan memperuntukkan kaedah ujian yang formal dan definitif untuk mengukur sejauh mana mandat rakyat diperolehi oleh kerajaan berkenaan.
Jadi, kita adakan pilihan raya untuk menguji sejauh mana sokongan di kalangan rakyat yang diperolehi oleh seseorang calon pimimpin. Persoalan dikemukakan dalam pilihan raya yan dikawal oleh undang-undang dan persetujuan yang mendahului masa.
Jika pilihan raya tidak diadakan, atau sekiranya pilihan raya itu diragui kebebasan dan keadilannya, maka persoalankeabsahan kepimpinan tidak dapat ditentukan.
Walau seramai mana pun orang berarak dan meneriakkan nama anda, semuanya itu tidak diambil kira. Anda perlu membuktikan bahawa anda mempunyai sokongan pengundi melalui pilihan raya yang bebas dan adil.
Sama juga, Perlembagaan menyediakan satu kaedah definitif untuk menguji sama ada seseorang Menteri Besar atau Perdana Menteri masih mempunyai majoriti di Dun atau Parlimen. Kita akan kemukakan undi tidak percaya di Dun atau Parlimen.
Apa yang akan diambil kira nanti ialah keputusan persidangan tersebut. Ia tidak mengambil kira sebanyak mana akuan bersumpah, peralihan sokongan, sidang media dan perisytiharan yang dibuat. Ia juga tidak mengambil kira berapa banyak bentuk pengiklanan, pameran, tarikan dan tenaga yang ditanggung bagi menghadapi persoalan tersebut.
Bagi menguji secara formal mandat kerajaan sekarang, sama ada di Perak, Sabah atau kerajaan Persekutuan, persoalan perlu dikemukakan kepada rakyat melalui pilihan raya negeri, atau menerusi persidangan melalui undi formal di dewan. Inilah ujian-ujian yang diambil kira dalam demokrasi berperlembagaan kita.
Inilah juga apa yang diertikan sebagai demokrasi berparlimen. Untuk menyingkir atau membentuk kerajaan melalui cara selain itu akan menyalahi Perlembagaan, melunturkan kuasa undang-undang dan berhadapan dengan risiko pembentukan kerajaan yang haram.
Pihak berkuasa yang sah hanya boleh ditubuhkan melalui kaedah demokratik seperti yang disebut oleh Perlembagaan. Kuasa yang sah dan betul berbeza sepenuhnya daripada kuasa buas yang boleh dibeli, jual atau dirampas menggunakan kekuatan.

Inilah ujian-ujian yang diambil kira dalam demokrasi berperlembagaan kita.
Inilah juga apa yang diertikan sebagai demokrasi berparlimen. Untuk menyingkir atau membentuk kerajaan melalui cara selain itu akan menyalahi Perlembagaan, melunturkan kuasa undang-undang dan berhadapan dengan risiko pembentukan kerajaan yang haram.
Pihak berkuasa yang sah hanya boleh ditubuhkan melalui kaedah demokratik seperti yang disebut oleh Perlembagaan. Kuasa yang sah dan betul berbeza sepenuhnya daripada kuasa buas yang boleh dibeli, jual atau dirampas menggunakan kekuatan.

KETUA UMUM - "LAGI LAGI SLOGAN MELAYU!....."
Ramai pengunjung, sms, emel yang diterima musykil dengan kebisuan saya berdepan dengan kecaman keras YB Karpal. Sdr Karpal adalah sahabat dan peguam handal yang begitu prihatin dengan kesengsaraan kami akibat kezaliman penguasa Umno-Bn.
Maka saya memilih berdiam dulu kerana sebarang keputusan isu dasar yang diumumkan adalah muafakat bersama dalam rangka Pakatan, setelah ada pertemuan di antara pimpinan Keadilan, Pas dan Dap. Saya juga sedar bahawa kenyataan Sdr Karpal sengaja dibesarkan oleh media Umno-Bn khususnya Utusan dan TV3.
Sekonyong-konyong beliau menjadi tokoh besar semata-mata kerana menegur saya. Keesokannya pula, lantaran pemuda umno muncul menjerit slogan Raja Melayu dan pengkhianat, maka sosok Sdr Karpal kembali sebagai anti Raja dan pengkhianat!Memang benar saya tidak bersetuju dengan cadangan menyaman Sultan walaupun cenderung menyokong tindakan menyaman kerajaan baru Perak yang tidak sah; tetapi ugutan pemuda umno termasuk menggunakan ISA dan tekanan polis adalah keterlaluan. Hak dan kebebasan beliau menyuarakan pandangan harus dihormati. Mengapa Umno pura-pura jahil dengan telatah melampau puak mereka menghina Sultan Terengganu, dan sebelum itu meminda Perlembagaan menghakis kusasa Raja dan akhirnya meluputkan kekebalan Raja?
Lagi-lagi slogan Melayu, Melayu. Alahai, bukit, pulau, empangan, balak, tanah, kontrak, saham kesemuannya bernilai ratusan bilion ringgit dirompak dan digadai oleh siapa?

DSAI - BN DALAM GUNDAH GULANA

DSAI - Tradisi Membenakkan Rakyat

Tindakan Kementerian Dalam Negeri yang bertindak merampas nashkah Suara Keadilan dan Harakah jelas menggambarkan ketidakmatangan Umno berhadapan dengan realiti kebangkitan rakyat.
Saya yakin dan percaya bahawasanya perkembangan mutakhir di Perak yang dikupas secara imperikal oleh blog-blog, dan kini didedah melalui media alternatif seperti Harakah dan Suara Keadilan membuatkan Umno-BN berada dalam keadaan gundah gulana.
Untuk apa dirampas akhbar berkenaan sedangkan akhbar-akhbar tersebut beroperasi secara sah menggunakan permit? Apa perlu ia dirampas jika benar Umno-Bn bertindak ‘dalam landasan yang betul’?
Utusan Malaysia, Berita Harian menyebarluas propaganda Umno-BN, menenggelamkan isu pencabulan perlembagaan oleh kerajaan haram BN di Perak dan memperbesarkan istilah ‘mohon derhaka’ Dato’ Seri Ir. Nizar.
Tambah menggelikan hati apabila Ketua Polis Negara melarang sebarang ceramah politik di seluruh Perak. Alasannya? Permit ceramah akan dibekukan sehingga “situasi kembali elok.”
Aduhai! Mengapa tidak diharamkan terus penggunaan komputer dan akses internet di seluruh Perak?
Rakyat semakin celik, dan akan terus getek melihat tindak tanduk Umno-BN yang kelihatan gagal belajar dari keputusan PRU-12.
Umno-BN boleh terus berusaha untuk membenakkan pemikiran rakyat, tetapi di akhirnya mereka akan tahu kelak bahawa rakyat tidak bodoh dan tidak mudah untuk diperbodohkan!

Pandangan Ahli Akademik Tentang Kedudukan Nizar
Pemansuhan kedudukan Nizar diragui kesahihannya - Pensyarah UKM
KUALA LUMPUR, 12 Feb (Hrkh) - Seorang pensyarah Sains Politik Universiti Kebangsaan Malaysia (UKM), Muhamad Nadzri Mohamed Noor mempersoalkan tindakan pemansuhan kedudukan Dato' Seri Nizar Jamaluddin sebagai Menteri Besar Perak tanpa melalui proses perundangan, yakni tanpa membuat persidangan Dun bagi membawa usul undi tidak percaya kepada Menteri Besar atau tanpa diputuskan mahkamah diragui tahap kesahihannya.
"Selain itu, sebelum pelantikan Dato' Dr Zamry, Nizar pernah memohon pembubaran Dun kepada Sultan Perak. Meskipun baginda mempunyai kuasa budi bicara, namun kuasa beliau sebagai Sultan juga adalah kuasa rasmi dan simbolik yakni beliau bertindak atas nasihat Menteri Besar," katanya lagi.
Oleh itu, di sini timbul satu isu kesamaran kuasa yang perlu diperjelaskan oleh pihak mahkamah, kata beliau kepada Harakahdaily.
Selain itu, ditanya mengenai keabsahan pelantikan Menteri Besar Perak yang berada dalam kemelut, beliau berpendapat terdapat beberapa persoalan berbangkit yang berkaitan dengan masalah perundangan.
"Persoalan lain, adakah peralihan sokongan atau keluar parti dua Adun KeADILan kepada BN adalah sah?
"Ini berikutan telah ada peraturan di dalam KeADILan yakni jika terdapat ahli meletakkan jawatan atau keluar parti semasa menjadi ahli badan perundangan, individu itu mestilah meletakkan jawatan perundangan tersebut. Namun, adakah peraturan ini (secara lisan atau tidak) terpakai dan boleh dikuatkuasakan?" tegasnya.
"Selepas segala kesamar-samaran status perundangan dan kuasa yang dibangkitkan, adakah perlantikan Dr Zambry dari BN sebagai Menteri Besar Perak oleh Sultannya adalah sah?
"Selagi isu-isu atau persoalan undang-undang ini yang tidak diselesaikan oleh pihak yang berwajib, khasnya mahkamah, legitimasi kerajaan baru boleh dipertikaikan dari pelbagai sudut (khasnya dari sudut undang-undang dan struktur politik)," ujar Nazri lagi.
Ini kerana katanya, keadaan tersebut boleh menyebabkan ketidakstabilan politik di Perak menjadi bertambah serius. Katanya lagi, meskipun BN kini tidak lagi hegemonik, tetapi ianya dilihat masih dominan dan berkuasa.
"Dengan kekuasaan ini, jika dilakukan secara strategik dan bijaksana, BN mampu mengukuh kembali kedudukan, melambat-lambatkan perubahan atau menghapuskan penentangan walaupun keadaan-keadaan ini tidaklah eksklusif. Namun jika tersilap langkah, strategi yang dilakukan boleh memakan diri," katanya.
Hal ini tambah beliau, bergantung kepada kematangan politik masyarakat Malaysia akhir-akhir ini. Justeru ujarnya, apa yang ditetapkan melalui institusi negara, tidak semestinya menghasilkan kepatuhan atau kepercayaan masyarakatnya.
"Tetapi dalam masa terdekat ia mungkin boleh menafikan realiti sebenar yakni dengan menolak gelombang perubahan, namun pada masa 'near future' ia mungkin melakarkan impak yang sebaliknya," ujarnya lagi.
Oleh yang demikian Nazri mengharapkan tindakan lompat parti di kalangan ahli politik tidak menjadi budaya pemimpin Malaysia kerana ia akan menggugat kestabilan politik negara dan menafikan hasrat serta mandat pengundi yang telah diberikan semasa pilihan raya.
"Biarlah proses yang paling demokratik yakni pilihan raya, yang menentukan siapa yang berhak untuk menduduki jawatan dalam pemerintahan. Ataupun jika timbul pertikaian diselesaikan dalam mahkamah yang bebas," katanya

SIAPA BERADAP DAN SIAPA KHIANAT

Siapa Beradap dan Siapa Khianat
Perak kini berada di dalam kemelut perlembagaan. Media massa yang dikuasai Barisan Nasional sudah dikerahkan untuk memutarbelitkan fakta bagi mengelirukan rakyat dalam perang propaganda. Pertama, dikatakan Datuk Seri Anwar Ibrahim yang memulakan insiden lompat ini dahulu. Kedua, Pakatan Rakyat dikatakan khianat terhadap DYMM Sultan Perak, Sultan Azlan Shah.
Sememangnya Anwar telah memulakan jemputan kepada wakil-wakil rakyat BN untuk menyertai Pakatan bagi peralihan kuasa Kerajaan Persekutuan. Tetapi jemputan Anwar ini dibuat dari awal, secara terbuka.
Malangnya, kali ini tindakan rampasan kuasa BN pimpinan Dato’ Seri Najib Razak diselubungi tipu daya, ancaman dan rasuah. Mula-mula, Dato’ Zainal Abidin Zin, mantan Timbalan Menteri Pertahanan mengakui membawa seorang pemimpin Keadilan Perak berjumpa Najib sejurus selepas pilihan raya umum 8 Mac 2008. Pemimpin tersebut mendakwa Najib menawarkan wang RM50 juta untuk mendapatkan beberapa wakil rakyat sekaligus menjatuhkan Kerajaan Pakatan Rakyat Perak.
Selepas itu, YB Osman Jailu dan YB Jamaluddin Osman ditekan dengan pertuduhan rasuah ketika menjadi exco Kerajaan Negeri Pakatan Rakyat. Kemudian, mereka hilang tanpa diketahui semua. Mereka mendakwa mereka cuti sakit, tetapi isteri mereka pun tidak tahu ke mana mereka pergi.
Kini, apakah status pertuduhan rasuah Osman dan Jamaluddin? Dahulu BN bermati-matian menuduh mereka bersalah, tetapi kini wujud dilema: jika mereka didapati tidak bersalah, rakyat akan menganggap itu sebahagian dari perjanjian untuk menyokong kerajaan BN. Jika bersalah dan dihukum, mereka boleh kehilangan kerusi mereka, dan lebih parah lagi, BN akan dianggap sanggup menerima sesiapa sahaja untuk mendapatkan kuasa mereka.
Anwar turut menulis kepada Yang Dipertua Dewan Rakyat untuk memanggil sidang khas bagi membuat undi tidak percaya kepada kerajaan dalam dewan. Tawaran Anwar juga dibuat dengan tekad untuk membubarkan Parlimen selepas peralihan kuasa agar tindakan itu mendapat mandat rakyat. Tindakan Anwar penuh adab kepada keluhuran perlembagaan dan prinsip demokrasi.
Namun, BN yang sebelum ini berhasrat menggubal undang-undang lompat parti kini diam membisu tentang mendapat mandat rakyat. Dewan Undangan Negeri sebagai institusi legislatif negeri dibelakangkan. Apatah lagi apabila Speaker DUN telah pun memutuskan Osman dan Jamaluddin meletak jawatan. BN boleh mempertikaikan hakikat tersebut, tetapi mereka hendaklah ambil tindakan mahkamah memandangkan Speaker sudah pun membuat keputusan.
Pandangan peribadi saya, tindakan menukar parti bagi seorang wakil rakyat seiring dengan prinsip kebebasan berpersatuan dalam perlembagaan. Pilihan ini membolehkan wakil rakyat mempunyai kuasa ketika berhadapan dengan kuasa eksekutif dan pimpinan parti. Tetapi mereka seharusnya berani berhadapan dengan penilaian rakyat yang boleh mengukur sama ada tindakan mereka dibuat di atas prinsip atau tidak. Tindakan mereka juga hendaklah bebas dari sebarang tekanan, ugutan mahupun habuan.
Tentang persoalan kedua, tindakan ghairah Najib lah yang mahukan peralihan kuasa dibuat dengan apa jua cara yang telah mencemarkan kemuliaan institusi raja berperlembagaan di negara kita. Sekiranya Najib sanggup menggunakan tindakan beradab dengan meminta pembubaran DUN atau persidangan khas DUN seperti Anwar, institusi raja tidak akan terheret di dalam kontroversi ini. Tetapi beliau terlalu ghairah setelah gagal bertarung di dalam gelanggang pilihan raya di Permatang Pauh dan Kuala Terengganu.
Khairy Jamaluddin pula cuba mengapi-apikan sentimen kononnya Pakatan khianat. Sebelum Mac 2008, Khairy cuba memakai topeng Ultra Melayu agar meraih sokongan. Tetapi selepas 8 Mac yang mana keangkuhan beliau turut dikatakan penyebab kehilangan sokongan BN, beliau berubah watak sehingga kelihatan pandangannya umpama pimpinan Pakatan. Tetapi sekali lagi dalam usaha mendapat sorakan orang ramai, beliau kecundang, memilih jalan pintas.
Pada Mac tahun lepas, penyokong parti mana yang mengibarkan kain rentang memanggil DYMM Sultan Terengganu “natang” (binatang)? Melayu hari ini tidak mudah lupa. Jelas, siapa beradab dan siapa khianat.
Najib menyatakan beliau bukan memulakan peristiwa lompat-melompat. Tetapi Najiblah yang memulakannya secara khianat dan tidak beradab. Pakatan menganjurkan peralihan kuasa, Najib memulakan rampasan kuasa.

Jika bersalah dan dihukum, mereka boleh kehilangan kerusi mereka, dan lebih parah lagi, BN akan dianggap sanggup menerima sesiapa sahaja untuk mendapatkan kuasa mereka.
Anwar turut menulis kepada Yang Dipertua Dewan Rakyat untuk memanggil sidang khas bagi membuat undi tidak percaya kepada kerajaan dalam dewan. Tawaran Anwar juga dibuat dengan tekad untuk membubarkan Parlimen selepas peralihan kuasa agar tindakan itu mendapat mandat rakyat. Tindakan Anwar penuh adab kepada keluhuran perlembagaan dan prinsip demokrasi.
Namun, BN yang sebelum ini berhasrat menggubal undang-undang lompat parti kini diam membisu tentang mendapat mandat rakyat. Dewan Undangan Negeri sebagai institusi legislatif negeri dibelakangkan. Apatah lagi apabila Speaker DUN telah pun memutuskan Osman dan Jamaluddin meletak jawatan. BN boleh mempertikaikan hakikat tersebut, tetapi mereka hendaklah ambil tindakan mahkamah memandangkan Speaker sudah pun membuat keputusan.
Pandangan peribadi saya, tindakan menukar parti bagi seorang wakil rakyat seiring dengan prinsip kebebasan berpersatuan dalam perlembagaan. Pilihan ini membolehkan wakil rakyat mempunyai kuasa ketika berhadapan dengan kuasa eksekutif dan pimpinan parti. Tetapi mereka seharusnya berani berhadapan dengan penilaian rakyat yang boleh mengukur sama ada tindakan mereka dibuat di atas prinsip atau tidak. Tindakan mereka juga hendaklah bebas dari sebarang tekanan, ugutan mahupun habuan.
Tentang persoalan kedua, tindakan ghairah Najib lah yang mahukan peralihan kuasa dibuat dengan apa jua cara yang telah mencemarkan kemuliaan institusi raja berperlembagaan di negara kita. Sekiranya Najib sanggup menggunakan tindakan beradab dengan meminta pembubaran DUN atau persidangan khas DUN seperti Anwar, institusi raja tidak akan terheret di dalam kontroversi ini. Tetapi beliau terlalu ghairah setelah gagal bertarung di dalam gelanggang pilihan raya di Permatang Pauh dan Kuala Terengganu.
Khairy Jamaluddin pula cuba mengapi-apikan sentimen kononnya Pakatan khianat. Sebelum Mac 2008, Khairy cuba memakai topeng Ultra Melayu agar meraih sokongan. Tetapi selepas 8 Mac yang mana keangkuhan beliau turut dikatakan penyebab kehilangan sokongan BN, beliau berubah watak sehingga kelihatan pandangannya umpama pimpinan Pakatan. Tetapi sekali lagi dalam usaha mendapat sorakan orang ramai, beliau kecundang, memilih jalan pintas.
Pada Mac tahun lepas, penyokong parti mana yang mengibarkan kain rentang memanggil DYMM Sultan Terengganu “natang” (binatang)? Melayu hari ini tidak mudah lupa. Jelas, siapa beradab dan siapa khianat.
Najib menyatakan beliau bukan memulakan peristiwa lompat-melompat. Tetapi Najiblah yang memulakannya secara khianat dan tidak beradab. Pakatan menganjurkan peralihan kuasa, Najib memulakan rampasan kuasa.

PENGHARGAAN BUAT SDR ARUMUGAM
Dukacita saya menerima perletakan jawatan Saudara V. Arumugam dari semua jawatan yang disandang beliau; sebagai seorang Ahli Majlis Mesyuarat Kerajaan Negeri Kedah dan Ahli Dewan Undangan Negeri Bukit Selambau. Mewakili seluruh pimpinan Parti Keadilan Rakyat, saya mengucapkan setinggi-tinggi penghargaan kepada Saudara Arumugam di atas jasa dan khidmat yang beliau berikan.
Kerana takutkan bayang-bayang sendiri, Umno-Bn sanggup menggunakan taktik kotor dan politik ugut mengugut ke atas wakil yang dipilih rakyat. Pendedahan YAB Ustaz Azizan pada sidang media sebentar tadi berhubung alasan perletakan jawatan Adun Bukit Selambau tersebut sangat mengejutkan bahkan mengesahkan laporan polis yang dibuat oleh Saudara Arumugam pada awal bulan ini berkenaan ugutan dan segala macam tekanan. Nampaknya perubahan yang dijanjikan hanyalah gimik semata. Rakyat sedar akan permainan silap mata ini, dan rakyat jualah yang akan menentukan keputusannya.
Buat pendokong Pakatan Rakyat marilah kita sama-sama renungi sirah Nabi S.A.W ketika mana Heraklius memanggil Abu Sufyan:
Heraklius: Adakah pengikutnya dari kalangan orang kaya atau marhaen.

Pertandingan Boling Ria Piala YB Yaakob Sapari dan YB Rodiah Ismail
PERTANDINGAN BOLING RIA
PIALA YB. YAAKOB SAPARI DAN YB RODIAH ISMAIL

Satu ertandingan Boling Ria Piala Y.B. Yaakob Sapari dan Y.B. Rodiah Ismail, anjuran Urusetia Boling Ria 2009 Taman TTDI Jaya telah berjaya dianjurkan oleh JDM TTDI Jaya di Pusat Boling Ole-Ole, Sek 19, Shah Alam, Selangor pada 7 Febuari 2009.
Pertandingan acara kumpulan yang terdiri dari 3 peserta untuk setiap kumpulan telah mendapat sambutan hangat di mana sebanyak 56 pasukan telah berentap untuk menjuarai piala YB Yaakob dan YB Rodiah. Sambutan yang amat menggalakkan itu telah menyebabkan penyertaan 25 pasukan lagi terpaksa ditolak kerana telah mencukupi kuota.
YB Yaakob telah merasmikan acara disebelah pagi manakala kedua dua YB Yaakob dan YB Rodiah telah hadir di sebelah petang untuk acara penyampaian hadiah. Hadiah menarik disediakan bagi juara kumpulan sehingga tempat ke 10, manakala hadiah juara bagi kategori individu lelaki dan wanita terbaik juga telah disampaikan oleh kedua-dua YB. Selain daripada itu acara diselang selikan dengan cabutan bertuah untuk 15 cabutan dengan hadiah utamanya iaitu sebuah TV 29 inci yang disediakan oleh penganjur
Setelah pertandingan berakhir, kedua-dua YB telah bersama-sama AJK mengambil kesempatan untuk bermain boling sebagai meraikan kejayaan penganjuran pertandingan tersebut.

Jeopardising The Nation

WHATEVER the impertinence, a comment by a not totally clueless outsider who holds Malaysia close in his attachments on the present constitutional crisis in Perak and its national political implications may prove useful and instructive.
Tough legal questions have been raised already with no simple answers. They are questions that serious Malaysian citizens are worried, and have the right to be concerned, about. I am too. Those questions need not be repeated here.
If I were the Sultan
Instead I shall compound my impertinence. Were I, however improbably, to have found myself in the position of the Sultan of Perak on 5 Feb 2009, I would have been strongly tempted — in good conscience and out of an impeccable sense of duty and for the best possible reasons — to have acted just as he did.
But I pray I would have resisted that temptation. I hope that, however tricky that different course might prove in the immediate and short term, I would have allowed the fate of a democratically elected government, under a system of constitutional monarchy, to be decided by the people in one of two ways.
Either on the floor of the people’s house by their own recently elected representatives, or else, if for some reason that was not feasible or acceptable, at an election that might explicitly test public opinion on the question. That way, the newly elected house, whether controlled by the Barisan Nasional or the Pakatan Rakyat, would authoritatively be that of the people’s, with whom modern democratic sovereignty originates.
Whether, as Ruler, I might have forced some resolution of the question on the floor of the house or acceded to the menteri besar’s request for a dissolution and new elections, the prospect in either case would have been one of an immediately heightened political temperature.
Either course would soon have seen mass public demonstrations of allegiance on both sides and, in their train, huge potential problems in maintaining civil peace and public order. That much is undeniable.
Any conscientious ruler or head of state would have to be deeply concerned at such a prospect.
As for the former option, I may be among the few surviving attentive witnesses to a similar episode long ago: the so-called “20 Aug 1968″ peristiwa in Kelantan. Then, some half dozen or more PAS state assemblypersons were to have defected and sided with Umno at a sitting of the state assembly in the old Balai Besar in the palace precinct in Kota Baru. It did not happen.
The PAS government of Kelantan was not toppled. The frogs did not jump. They stayed under the sheltering tempurung of the party in whose name they had been elected.
But I still recall the very tense and at times frightening atmosphere as I travelled by motorcycle, through police and army roadblocks, the 25 miles from Bachok to Kota Baru and the roiling, ever-growing crowds that, along with me, were converging ominously there on that fateful morning.
These are not matters to be trifled with nor risks to be taken lightly — least of all by a constitutional head of state with a proper sense of public responsibility and duty. So avoiding that fearful possibility would have been a great temptation, and a not ignoble one. But it is a temptation that I hope I might have resisted. Why?
Learning from Australia
In Australia in 1975, the Governor-General Sir John Kerr chose to act similarly in a similar situation. He insisted on exercising his personal discretion that, as he understood the situation, his constitutional “reserve powers” entitled him to wield. He dismissed a government that arguably still had a majority within the people’s elected house of parliament.
The result was unfortunate, to say the least. It poisoned Australian politics, public culture, and (dare one say it?) the very soul of the nation for a generation. Its effects have not fully worn off away even now.
Malaysia could now be at risk of a similar outcome. I hope not but fear so.
For that reason, a test in the state assembly or snap polls would have been preferable whatever the costs and however messy the shorter-term practicalities of maintaining public order. As a matter of long-term public and national policy, that would have been better than a measure that substituted something else for the verdict of popular will.
In Australia it is now widely recognised that, if the government was not to have fallen on its own, it should not have been peremptorily dismissed. And if it was doomed to fall, as well it may have been, it should have been allowed to do so in the natural course of democratic events, through democratic processes. The impatience to force the issue may have saved a few days or weeks of delay but it plagued the nation with its consequences for thirty years until the matter began to be put decently to rest.
It was not a good deal. Not for anyone. Not for the ousted Prime Minister Gough Whitlam. Not for his successor Malcolm Fraser who never overcame the “legitimacy deficit” that his manner of coming to power caused him. Not for Kerr who went into exile and died amidst widespread ignominy and contempt. Not for Australia, which was made to live for a generation under the shadow of what was widely seen as a quasi- or pseudo-constitutionalist coup against constitutionalism. And not, therefore, for constitutional principle and process itself.
That is an outcome and fate that Malaysia, I hope, will avoid. The lesson is there already to be learnt from others. The same price need not be paid again.
Malaysia these days has other urgent needs and priorities. It does not need, now to be paid exorbitantly on its own account, this distraction or these afflictions. The lesson is available free, there to be taken “ready off-the-shelf”, from Canberra.
Former Lord President Tun Mohamed Suffian Hashim repeatedly insisted in his foundational written texts that in Malaysia, the constitution and nothing but the constitution is “the supreme law of the land”. Malaysia cannot afford to see constitutional principles imperilled, and constitutional processes jeopardised — not even out of an understandable impatience, or a conscientious determination, to see the urgent political and practical problems of the day speedily resolved.

As a matter of long-term public and national policy, that would have been better than a measure that substituted something else for the verdict of popular will.
In Australia it is now widely recognised that, if the government was not to have fallen on its own, it should not have been peremptorily dismissed. And if it was doomed to fall, as well it may have been, it should have been allowed to do so in the natural course of democratic events, through democratic processes. The impatience to force the issue may have saved a few days or weeks of delay but it plagued the nation with its consequences for thirty years until the matter began to be put decently to rest.
It was not a good deal. Not for anyone. Not for the ousted Prime Minister Gough Whitlam. Not for his successor Malcolm Fraser who never overcame the “legitimacy deficit” that his manner of coming to power caused him. Not for Kerr who went into exile and died amidst widespread ignominy and contempt. Not for Australia, which was made to live for a generation under the shadow of what was widely seen as a quasi- or pseudo-constitutionalist coup against constitutionalism. And not, therefore, for constitutional principle and process itself.
That is an outcome and fate that Malaysia, I hope, will avoid. The lesson is there already to be learnt from others. The same price need not be paid again.
Malaysia these days has other urgent needs and priorities. It does not need, now to be paid exorbitantly on its own account, this distraction or these afflictions. The lesson is available free, there to be taken “ready off-the-shelf”, from Canberra.
Former Lord President Tun Mohamed Suffian Hashim repeatedly insisted in his foundational written texts that in Malaysia, the constitution and nothing but the constitution is “the supreme law of the land”. Malaysia cannot afford to see constitutional principles imperilled, and constitutional processes jeopardised — not even out of an understandable impatience, or a conscientious determination, to see the urgent political and practical problems of the day speedily resolved.

Siaran MEdia DSAI tentang usaha memerangi rasuah

---Kuala Lumpur, 15 Disember 2008---
Ketua Pembangkang Datuk Seri Anwar Ibrahim menyambut baik usaha untuk memerangi rasuah. Walaubagaimanpun beliau menegaskan penubuhan Suruhanjaya Pencegahan Rasuah Malaysia (SPRM) masih mempunyai kelemahan ketara kerana masih terikat dengan kuasa eksekutif terutamanya Perdana Menteri.
"Pakatan Rakyat akan sokong usul yang dibawa oleh Perdana Menteri itu dengan syarat pindaan memberikan Suruhanjaya lebih kebebasan termasuk kuasa pendakwaan," demikian dinyatakan oleh Ahli Parlimen Permatang Pauh itu.
Datuk Seri Anwar menekankan bahawa menurut seksyen 5(1) dan seksyen 5(3), perlantikan Ketua Suruhanjaya dan Lembaga Penasihat Pencegahan Rasuah yang berasaskan seksyen 13(2)(a), masih di atas nasihat Perdana Menteri. Peruntukan ini membuktikan Suruhanjaya yang dimaksudkan masih belum bebas sepenuhnya dan dikhuatiri ianya terdedah kepada sebarang manipulasi eksekutif.
Berucap di Dewan Rakyat sebentar tadi, Datuk Seri Anwar Ibrahim telah mengingatkan Dewan Yang Mulia akan kes-kes rasuah terdahulu, berprofail tinggi dan membabitkan orang-orang ternama. Namun apa yang dikesali ialah tiadanya tindakan tegas dari pihak yang berkuasa. Kita masih menunggu sebarang tindakan tegas diambil bagi kes-kes melibatkan wang Perwaja dan MAS.
Ketua Pembangkang juga menyarankan bagi memastikan Suruhanjaya tersebut bebas, ahli-ahlinya mestilah dilantik oleh Jawatankuasa Khas Parlimen agar calon yang paling layak sahaja dilantik, bukan sahaja dari segi teknikal tetapi juga bersih dari tuduhan dan celaan. (tamat)

Ladies and gentlemen.
Your sacrifices have shaped the course of this nation.
Your tears for friends and loved ones imprisoned without trial; your pain in enduring your families being torn apart; and the anguish seeing your businesses and livelihood ransacked.
This is the price that we have all paid to build a better Malaysia.
But I stand before you, humbled by your courage, overwhelmed by your loyalty, and inspired by your extraordinary feats.
From a dark cell I felt your pain. I cried when your freedom was taken from you. And today I share your pride and joy; that we are gathered here to celebrate the historic event our fellow Malaysians brought forth on March 8 - a Brave New Dawn.
I welcome the new faces among us. When we formed this party we knew a day would come when we would open our doors to a flood of Malaysians joining us on this noble mission. Your presence marks the beginning of a new phase for our party and for our nation.
I marvel at the support we have earned from our nation’s youth and women. You have given us hope that Malaysia’s future will fall into the hands of a generation that cherishes democracy and will continue the fight for freedom and justice.
With this Congress we embark on a major exercise to refocus and reorganize the party to reach new levels of discipline and new heights of effectiveness. We will take steps to ensure that our call for justice is heard loud and clear from the northern reaches of Perlis to the southern tip of Johor and all the way to the shores of Sabah and Sarawak.
Yet it was not too long ago that many believed this party had no future. They poured scorn on our aspirations and laughed at our dreams. Some even said we would just disappear!
They said multi-racial politics were impossible and our vision for a unified nation had all but expired. There are some whose conviction wavered and who believed that the ship upon which we were sailing may not reach its destined shore. To those who harbor doubt I say: trust in the wisdom of the people and trust not the pundits and cynics bent on supporting a corrupt and decadent establishment.
The desire for change is unstoppable. The people can no longer tolerate the abuses of the current government that affront us each day. The prevailing order prevails no more.
Never in the country’s history have Malaysians in such great numbers exercised their right to vote out of office such an entrenched institution. Never before have the people set aside their racial and religious identities and called in a single voice for a Brave New Dawn.
Our successes in 2008 are immense and we should be immensely proud. After two successful elections we have a proven that the Pakatan Rakyat coalition is strong and unified, working together hand-in-hand for change.
We have also witnessed a government under siege and a ruling party in disarray. We have seen them strangle and suffocate the democratic process and we have seen them ignore the crisis of an economy in turmoil.
Yes there have been setbacks. We skirted with destiny on September 16th and despite our best efforts our march to victory has been delayed. I empathise with you and with the people of Malaysia. We are all forced to further endure the slings and arrows of an incompetent government that has lost touch with the people. Although our promise has not yet been fulfilled, the Pakatan Rakyat leaders and I remain committed to the agenda for change and our tenacity has never been stronger.
I call upon you to aspire -- as only we united in our quest can -- to A Brave New Dawn: Where every child has the right to quality education and every family feels safe at home and in their streets. Where we can believe what we read in the newspapers and what we watch on the television. Where the country’s leaders will be honest, where justice prevails and where judges cannot be bribed.
I ask of you first as Malaysians and second as members of Keadilan, let us prepare ourselves with a renewed resolve and the courage of conviction that with our efforts a thousand flowers of freedom will yet bloom in Malaysia.
To my fellow citizens in the Pakatan States, you have humbled me with your support and I thank you. I say to you – let us work together to bring forth a new order and a better quality of life; a new measure of confidence in the accountability of government. I ask you to bear with us; the challenges we face cannot be overcome in a single month and some may take more than a year to redress. Much has been accomplished already, and soon our State Governments will report regularly their accomplishments and their plans for the continued development of our states.
To those living outside the Pakatan States the task before you is formidable. You believe in Keadilan and you believe that with Pakatan Rakyat the future of the country can be great. Yet you live in the stronghold of Barisan Nasional. We need your unwavering commitment and we need you to work harder than ever before so that Pakatan Rakyat’s banner can be raised throughout Malaysia.
We in Pakatan Rakyat will continue to protect the rights of every Malaysian including the Malays and Bumiputeras, and strive to bring forth greater quality of life for all. We will reach out to our friends in Sabah and Sarawak - Ibans, Kadazahns, Dayaks. Your cry for help has been ignored. We in Pakatan Rakyat say we hear you and we will support you.
Members of Keadilan: Your work has brought our people together. Look around you. Our ancestors might not come from the same place. But we are citizens of this nation and we each want this country to move in the same direction to make it a better home for our children and grandchildren who - we hope - will be living together peacefully. And for them we wish a nation that is prosperous where they can obtain a good education and find a decent job to support their families.
These are Malaysian problems. They are not just Malay, Chinese, Indian, Iban, Dayak or Kadazans problems. They are ones that affect Sabah and Sarawak the same way that they matter to people living in Selangor, Penang, Kelantan or Johor. They are problems that we all face, day after day. And will continue to face unless we work harder for change.
Today our nation is confronted with monumental challenges. The economy is in virtual crisis. Violent crime in our cities and villages has never been more pervasive. More Malaysians are jobless, or will lose their jobs in the coming year then ever before in our history. Our education system is crumbling just like the buildings in which our children attend school. Billions are wasted every year in blatant corruption while the poor and marginalized are left hoping for some reprieve.
We have called this gathering to celebrate our success but I am now calling you to arms. Let us renew our commitment. Let us resolve to build on what has been accomplished this year and make Malaysia great once again.
Let us fulfill our promise to our friends in Pakatan Rakyat, DAP and PAS, to build a strong partnership. We have shared aspirations for the country and we are stronger as a coalition than the sum of our parts. Together we will win the hearts and minds of the entire nation.

Parti Keadilan Rakyat (KeADILan) telah dimaklumkan tentang adanya beberapa poster dan kain rentang yang telah diletakkan di beberapa tempat di Kuala Lumpur tentang suatu perhimpunan dan perarakan ke Istana Negara pada 16 September 2008 yang kononnya dianjurkan oleh Parti Keadilan Rakyat.
KeADILan dengan ini ingin memaklumkan bahawa ia TIDAK sama sekali terlibat dalam penganjuran mana-mana perhimpunan mahupun perarakan ke Istana Negara pada 16 September 2008 seperti yang diwar-warkan. Penyebaran maklumat palsu yang melibatkan PKR ini dilihat sebagai suatu usaha terdesak pihak tertentu yang mahu menimbulkan kekacauan dan mencetuskan ketidaktenteraman awam dan akan seterusnya menimbulkan kebimbangan kepada warga penduduk Kuala Lumpur.
KeADILan juga menasihatkan orang ramai agar tidak terpedaya dengan sebarang dakyah palsu yang sedang dijaja dan disebar secara meluas oleh golongan jahat yang mengamalkan politik fitnah tentang penglibatan PKR dalam mana-mana aktiviti yang melanggar batas-batas kesusilaan dan prinsip demokrasi, yang secara nyata bertujuan untuk memburukkan pertalian yang baik di antara PKR dan Dulu-Duli Raja-Raja Melayu.

The Morality of Members of Parliament Crossing the Floor
Response to Bar Council and Others
The Bar Council, Harris Ibrahim and Sean Ang are reported in the New Straits Times on September 10, 2008 to have said that Members of Parliament crossing the floor to join another party is legal but immoral. It is therefore necessary to draw the attention of the public to several fundamental principles with regard to the issue on the morality of MPs crossing the floor. Crossing the floor to sit as a member of parliament in another political party is nothing new in parliamentary democracies. It has been described as the height of treachery. It has also been praised as the stuff which parliamentarian heroes are made of. The great Sir Winston Churchill is perhaps the most famous parliamentarian to cross the floor and switch allegiance on more than one occasion. There is no dispute that crossing the floor for money or personal gain is both immoral and a betrayal of the voters' trust. However, when the MP crosses not for personal gain but in the interest and welfare of his constituents then he should be commended.
The Arguments for Immorality
The argument that crossing is immoral is that the MP was elected on his erstwhile political party's ticket and that is amounts to a fraud on his voters. This argument is founded on two assumptions. The first is that the MP's seat belongs to the political party. The second is that the MP was voted in based on his party's platform and policies. The assumptions are wrong and the argument has failed to take into consideration several objectives and purposes of certain fundamental principles of a parliamentary constitutional system. Upon a proper understanding of these fundamental principles it will be seen that far from being immoral, the ability for MPs to cross the floor is not only moral but part of the democratic process.
The Electoral System and the Power of the 222
The argument that the voters have elected the MP on the party's ticket and that the seat belongs to the party and not the MP arises from a confusion over the nature of the electoral systems in use. There are two major electoral systems in the world's democracies:
• The first is the constituency-based electoral system. By this system, voters in each local area or constituency elect an individual candidate. The person who wins the majority of votes in each constituency becomes a member of parliament. The party with the majority of MPs forms the government. In this system, the individual MP and not the party holds the seat. This means the MP can cross the floor and still keep his seat
• The second is the proportional representation system. By this system, the electorate in a large area, for example, a province or a country votes for political parties. The political party chooses the people who will become MPs. Each party is allocated a number of seats proportional to the number of votes it receives in the election. In this system, the seat belongs to the party and the MP who crosses the floor cannot keep his seat.
The electoral system used in Malaysia is the constituency-based system. Therefore the argument that the MP has stolen his party's seat when he crosses the floor is not supported upon a proper understanding of the constituency based electoral system. The constituency based system provides for individuals and not political parties to be the candidates for elction to the Dewan Rakyat. This is shown by independents, persons who do not belong to any political party, to contest. The candidate is elected not only on the policies and political ideology but also his personal character and capability. The policies and manifesto of the individual candidate will substantially be similar with the policies of other candidates from his party but there will also be differences according to the specific needs of the constituency and the candidate's own capabilities. The party ticket is therefore a grouping of individual candidates professing to hold similar policies and ideology. However, the constituents are voting for the individual candidate based on his policies, his personal capabilities and personal commitment.
The party ticket argument also fails to give effect to the provisions of Article 43(1) and 43(4) of the Federal Constitution. Article 43(1) provides that the Yang Di-Pertuan Agong is to appoint the Prime Minister who in his judgment is likely to command the confidence of the majority of the members of the Dewan Rakyat. Article 43(4) provides that the Prime Minister is to tender the resignation of his cabinet if he ceases to command the confidence of the majority of the members of the Dewan Rakyat. The effect of our electoral system and the operation of these two articles is that the constituents have given the power to the majority of the 222 members of parliament to decide who, from amongst them, is to be the Prime Minister. The tenure of the 222 and their power is fixed. It continues until the next general election. The tenure of the Prime Minister, however, is not fixed and not immutable. It is subject to the Prime Minister continuing to enjoy the confidence of the majority of the 222 throughout the term of the Parliament. By its very nature the confidence enjoyed by the Prime Minister is capable of being lost and changed. This can be due to many factors including where the Prime Minister is unwilling or unable or inept in performing his duties or has failed to properly implement policies or no longer enjoys the confidence of the people or if there is a shift of public opinion as to the desirability of keeping him in office. The power to remove the Prime Minister in practice includes and requires the members of parliament crossing the floor. It is this ability to cross the floor that ensures that only a capable Prime Minister can hope to see the end of the Parliamentary term. The failure for the MP to act is that he will be unlikely to be re-elected by his constituents at the next General Election. It is thus the MP's moral duty to cross the floor if necessary to ensure that an inept Prime Minister do not remain in office.
The MPs Duty and Good Conscience
The argument that the MP betrays his voters by joining another party glosses over basic principles governing an MP's duties and his need to exercise independent judgement. The word "democracy" comes from the Greek word "demokratia" which means "government by the people". The MP is elected to be the voice of his constituents and not to be the voice and handmaid of his political bosses. The MP and his constituents are the conscience of the Executive. The Honourable K. Rozzoli, Speaker of the NSW Legislative Assembly has described this as follows:
"A democratically elected Parliament is the only true voice of the people and accountability to the people it serves is the basic plank of a democratic system, however, no matter what forms of statutory accountability we bring to bear, true accountability lies in the conscience of both the people and their representatives."
The Honourable Speaker also explained that an MP's duties owed to his constituents prevail over that to his political party:
"The primary duty of a member is to his constituents who live within the electorate…The second duty is to help people outside the electorate… The third duty is to the Parliament, both to the institution itself and to the general dignity and process of the Parliament… The duty which exists to one's political party is, I believe, not a duty. It is something we assume as an extra curricular activity."
The paramount duty of the MP is therefore to act in the interest and welfare of his constituents and the next in the order of priority is to the Parliament. The Parliament, is the second pillar of government. It is one of the three institutions in the concept of the separation of powers of the government. It is to act as a check and balance to executive power. The Parliament is the avenue, through the principle of parliamentary privilege, by which the people may explore alternatives to the Executive's proposals, to expose a wrong or an injustice. The people vote their parliamentarians to guard their liberties and to query the activities of the Executive and its servants. It is in the ability of the Parliament to challenge the Executive that provides the real restrain to an overzealous or unwise use of authority. The Parliament is therefore not created to be "a rubber stamp" of the Executive. The parliamentarians have a duty to be independent minded and are not put there by the people to be "yes men" for their party bosses. The British had more than a hundred years ago derided members of parliament who followed party orders without questions. William Schwenk Gilbert in "Iolanthe" lamented:
"When in that House MP's divide
If they 've a brain and cerebellum too
They 've got to leave their brains outside
And vote just as their leaders tell 'em to"
In more mature democracies, it is not unusual for members of the House of Commons to cross the floor or those members who generally support the Government to speak and vote against the Government. It is not unusual for members of the US House of Representatives or Senate to sit on either side of the House in a division. It is because of this that a democrat like Joe Liberman can follow his conscience to endorse a Republican John McCain as presidential candidate. It is because of this that a President Nixon can be impeached for Watergate. The problem in Malaysia is that no BN MP has in 51 years crossed the floor of our Dewan Rakyat. The Government controlled media had ensured that any vote against the ruling party or even a dissenting voice is labeled as an act of treachery. The idea of BN MPs crossing has therefore been quickly castigated as immoral without examining whether good conscience demands that the MP cross the floor resolutely according to the needs of his constituents' interest or to remain in sterile stupor according to the dictates of his party bosses. The Watergates of Malaysia shall until then be destined to remain unearthed, unheard and unseen unless and until those elected to be the voice of their constituents find the courage to act according to their conscience. For so long as members of parliament from the ruling party conduct themselves as the proverbial three monkeys of "hearing no evil, seeing no evil and speaking no evil" about their party bosses, then the independence of Parliament does not exist. There is no check and balance by the Parliament of the Executive and only a "rubber stamp". The political tsunami that swept away the shackles to an independent judiciary must now also free the legislature from its bondage.
Constitutional Convention and Expression of Public Morality
The ability for members of parliament to cross the floor is the expression of public morality and not of immorality. Article 43(4) of the Malaysian Federal Constitution provides that the Prime Minister is to resign his cabinet upon ceasing to command the confidence of the majority in the Dewan Rakyat. Our Constitution is modeled on the British Westminster Constitution. It is a collection of constitutional conventions and customs. It is the outcome of centuries of constitutional evolution. It has distilled and crystallized the essence of the expression of public values and public morality. The convention to provide members of parliament with the ability to cross the floor and thereby bring about the removal of a government is thus an expression of public morality.
The ability to allow MPs to cross the floor recognizes that there may be a significant shift in public opinion that does not require fresh elections but needs to be reflected in the Parliament. The ruling party may be unable or unwilling to implement policies promised to the electorate. This can then be given expression through the MPs crossing the floor. It is this ability that curtails the power of party bosses and makes for a more vibrant political atmosphere. It provides for greater democracy and greater sensitivity to public opinion during the Parliamentary term otherwise it inculcates the Executive to become an authoritarian regime relying in the knowledge that it does not have to account to the people for the next five years.
The improper use of the ISA, the Sedition Act, the requirement of police permit to prevent the people from exercising its right of free speech and freedom of assembly and the abuse of power to shut dissent must not have to wait for general elections every five years. It is the duty of the 222 to ensure that the Executive power remains in check. It has become even more imperative that the BN MPs be able to vote according to their conscience. Yesterday, 12th September 2008, Raja Petra Kamaruddin, Selangor State Exco member and Member of Parliament for Seputeh, Ms Theresa Kok and the reporter from Sin Chew Daily News, Ms Tan Hoon Cheng who published the Ahmad Ismail speech have been detained under the ISA. Now is the time to act, the nation cannot wait for five years.
The Tectonic Shift after 308
Since the March 8 General Elections, the Barisan Nasional leaders have shown they are unwilling, unable or indifferent in addressing the challenges facing the nation. Despite, the global shortage of food and the increasing price of essential food products, the Barisan National leadership has refused to dismantle the monopoly given to Bernas in the privatization of the distribution of imported rice. With the global economic slowdown and rising inflation and the US going into stagflation, the BN leadership increased petrol prices by a massive and unprecedented increase of 70 sen causing inflation to jump to 8% per annum. It then did a flip flop by reducing the petrol price to 15 sen but this is too little too late to stop the galloping inflation led loose by the irresponsible increase. The property sector and the construction industry have come to a standstill due to the substantial increase in the price of building and construction materials. The SMIs are crying for help as the sudden jump in operation costs in electricity, petrol and transport costs threaten to put them out of business. Violent crime continues unabated after the General Elections. Murders, rape and robberies haunt the people every day. This indifferent and inept performance has led to a shift in public opinion of tectonic proportions after the March 8 General Elections. The Barisan Nasional leadership has failed. They have shown to be unworthy of commanding confidence of the majority of the Members of Parliament. Good conscience demands the BN MPs who still wish to hold true to the duty to their constituents have an obligation to cross the floor. It will be immoral for them not to.
Conclusion
The ability of the Members of Parliament to cross the floor and by doing so bring about a change in the government is part and parcel of the democratic process. It is a form of check and balance. It ensures that the sitting government must continuously be sensitive to the needs and opinion of the people or risk being removed before expiry of its term. The famous words that a democracy is said to be a "government of the people by the people and for the people" must include the right of the people to remove the government when it no longer represents the people. When Members of Parliament cross the floor acting according to the dictates of the people and not the dictate of the party bosses, they are acting morally and not immorally.

AUG 7 — We have been incessantly reminded by government leaders that we should abide by the law. That, in order for justice to prevail, we should uphold the rule of law. The Prime Minister again reminded us that we should be fair and that the law must allow a complainant to seek legitimate redress.
The Prime Minister cautioned the public to “remember” that there is a valid complaint by Mohd Saiful Bukhari Azlan against Datuk Seri Anwar Ibrahim to be entertained. That it was, after all, done in accordance with the dictates of the law.
That, again, any public outcry against the charges framed against Anwar is unnecessary and would jeopardise peace and order in society. As we moved into another series of the Anwar Ibrahim trials, reminiscent of the 1998 saga, we have again been given legal tutelage by government ministers.
It is assumed that as long as the process involves the court of law, justice would prevail. It is also assumed that a charge can only be framed in the face of credible evidence, as weighed by the institutions of justice. These are the assumptions thrown about in the mainstream media on a daily basis, so that the people understand and appreciate that the fair game of justice is at work.
We have been made to understand that we should let the law take its course. Lady Justice, holding the balancing scales, would forever be blinded from prejudices and would decide without fear or favour. The assumption is only theoretically correct, lest we forget that even justice can be a game, with willing pawns, charting its own rules for its own needs.
The free use of the terms “rule of law” and “due process” as a means to justify action by politicians demands serious examination. As simple as it sounds, “rule of law” in fact reflects a serious concept which has often been misused and its philosophical and jurisprudential considerations largely ignored.
First and foremost, rule of law does not equate to mere application of rule by law, regardless of the substance of the law invoked. Throughout history, laws have constantly been challenged for elements of discrimination and oppression. Hence, even the substance of the law must be examined before the application of the law can be accepted.
Secondly, rule of law, even at its most minimal level, demands the application of the law to be devoid of external influences, especially governmental influence and that the institution adjudicating the laws ought to be free from corruption. External influences create ripples of instability, which may grow and endanger the order and legal certainty that is assumed with the rule of law.
Rule of law shares an extremely intimate relationship with the other dimensions of a democratic government. In the truest form, it demands an independent judiciary, political rights, civil liberties and mechanisms of accountability to ensure that it remains true to form.
Thirdly, we have to understand that rule of law rests on the pillar of democracy. In a society where the word of the minister is often quoted to be the gospel truth, we need to urgently step back and recall Thomas Paine’s warning that “in absolute governments, the King is law, so in free countries the law ought to be King and there ought to be no other”.
Before parading the rule of law to diplomats and the media, as constantly exercised by Home Minister Datuk Syed Hamid Albar, we have to first honestly answer if we have been a free country in our practice of the law. We are hard pressed to honestly answer if we have been a country which protects, strengthens and empowers the agents of the rule of law.
Democracy, protection of human rights and protection from bureaucratic caprice and corruption certainly cannot be divorced from the discussion with regards to the rule of law. Any attempt to do so means that the rules which have been promulgated exist within a system which is known only to autocratic despots and German Nazis.
The notion that rule of law is an automated system which guarantees justice cannot be true when the substance of the law and its agents are constantly questioned even by the very people governed by the system.
Serious doubts and questions were asked by the Bar Council and the public, mainly through the alternative media, on the veracity of the charges made in the police report. Yet, the questions posed were replied by affording denials, almost evasive if one were to recall the media statements made by Hospital Pusrawi on the medical report of Saiful Bukhari.
The call by the Prime Minister himself for Anwar to “deliver” his DNA to the authorities is another incident which smacks of legal and scientific ignorance. The public demanded answers and obtained denials. They may have been “answers” but in fact, they created further questions and undoubtedly fuelled further speculation. More damaging, the “rule of law” as practised in Malaysia, now hangs precariously for the whole world to see.
The controversial trials of Norita Samsudin and Datuk Norjan Khan and, lately, of Altantuya Shariibuu certainly beg the question of whether the rule of law is in place. In the eyes of the public, the institutions of justice have not “delivered” up to expectations. The lack of public confidence automatically means the lack of “legitimacy”. In short, the rule of law cannot exist in the true sense when it is administered by a questionable system.
The philosophy of punishment is deterrence. Yet, there would be none should the delivery mechanism be tainted with abuse and doubted by the people it serves.
Rule of law demands categorical commitment to democracy and basic protection of human rights. Anything less means that we are not entitled to invoke it as a tool to justify action. The rights of not one but all citizens are at risk without a vigorous application of a truly democratic rule of law.
Often quoting or misquoting the “rule of law” in order to justify questionable action in the face of glaring questions is a retrogressive and an unabashed embrace of Machiavellian politics — that the end justifies the means. Getulio Vargas, the former Brazilian President, was reported to have said: “For my friends, everything, for my enemies the law.” Such is the power of the law.

I know I am uncharacteristically efficient posting things out on this list, but given these murky times in contemporary Malaysia, I will plead this indulgence, “among friends…”
Anwar was released on bail today.
The original report against him which claimed sexual assault appears to have been ammended, and he was charged with consensual anal intercourse instead (yes, that is the lexicon of the day in oh-so-sanctimonious Malaysia of Islam Hadhari). His alleged ‘willing’ partner, however, as of now, appears to be free of such a charge.

Malaysia’s Election Commission set a date yesterday for a parliamentary by-election which opposition leader Anwar Ibrahim is contesting. Also yesterday, the police summoned him to court to face charges in a highly questionable sodomy case.
It’s hard to believe that the convergence of these events is a coincidence. Mr. Anwar’s three-party coalition claims it has enough support to topple the current government, should Mr. Anwar win the Aug. 26 by-election. Fully 66% of 1,030 Malaysians surveyed nationwide last month by an independent polling company agreed that the sodomy charge was “a politically motivated action to disrupt Anwar Ibrahim’s political career.”
In a smaller poll conducted this weekend by the same company, 72% of Malays — which traditionally support the ruling United Malays National Organization — said they didn’t believe the allegations were true.
The police haven’t done much so far to prove otherwise. But Malaysians certainly also recognize in the current case echoes of the political games that have tormented Mr. Anwar and embarrassed their country before. Back in 1998, the government of then-President Mahathir Mohamed threw Mr. Anwar in jail on sodomy charges, just as Mr. Anwar was challenging the head of state’s leadership.
Although Mr. Anwar was subsequently convicted of sodomy and corruption, a high court overturned the sex charge in 2004, less than a year after Mr. Mahathir retired from office.
Drop Political Charges Against Opposition Leader

The Malaysian government should immediately withdraw politically motivated charges against opposition leader Anwar Ibrahim, Human Rights Watch said today. Police served Anwar, who is running for office, with an order to appear in Kuala Lumpur Sessions Court on August 7, 2008, under a colonial-era law that criminalizes homosexual conduct.
But several instances of misconduct around the investigation into allegations that Anwar had sexual relations with a male former aide show the charges are aimed at preventing Anwar from leading a new government. Police handled the inquiry improperly, while government officials interfered in it andtried to publicly intimidate and embarrass Anwar.
On August 26, Anwar is due to run in a by-election for the constituency vacated on July 31 by his wife, Dr. Wan Azizah Wan Ismail. On August 6, police ordered him to appear in Kuala Lumpur Sessions Court to face charges under section 377 of Malaysia’s criminal code, which criminalizes “carnal intercourse against the order of nature.”
“The Malaysian government appears to be manipulating the legal system to shore up support for its continued rule and undermine the opposition,” said Brad Adams, Asia director at Human Rights Watch.“This case is really about preventing challenges to the government’s rule.”
There is no legal impediment to Anwar’s running in the by-election, but denial of bail would prevent him from campaigning. Although a “sodomy charge” is a non-bailable offense, common practice has been for bail to be granted. Given Anwar’s high public profile, Human Rights Watch said that bail should be granted, as there is no evidence that he is a flight risk or will intimidate the complainant or any witnesses.
The police investigation into the allegations against Anwar, who was arrested on July 18 and interrogated about the accusations, has lacked transparency and impartiality. Police refused to publicly release the first information report filed by the complainant, Saiful Bukhari, as required under Malaysian law. This has fuelled suspicions that the document may have been altered after Anwar’s arrest.
Even more damaging to the credibility of the police investigation and the Malaysian government has been their response to a medical report by the first doctor to examine Saiful. The report of an anal examination conducted by a doctor at Hospital Pusrawi, and leaked on the internet on July 29, found no evidence of “sodomy.” Kamaruddin Ahmad, the hospital’s medical director, verified the report asauthentic, but said the doctor who examined Saiful was a general practitioner, not a specialist, and that the examination was not “sodomy-related.”
Deputy Inspector General of Police Ismail Omar dismissed the report’s relevance, describing it “as an attempt to sabotage police investigations” and confuse the public. Ismail also told reporters thatpolice are considering investigating news sources that leaked the medical report.
“The authorities seem more concerned with investigating how the medical report was leaked than with the fact that its content doesn’t support the criminal charges,” said Adams.

The government of Prime Minister Abdullah Badawi has faced serious challenges from opposition parties since the national election in March 2008 in which the ruling Barisan Nasional (National Front)lost its two-thirds majority in the parliament and control of five states. Public opinion polls in Malaysia indicate little support for the prosecution of Anwar.
An opinion poll released on August 1 by the Merdeka Center for Opinion Research found only 11 percent believed the sodomy allegations, while two-thirds believed the charges are politically motivated. Only a third expressed confidence that institutions such as the judiciary, the police and the attorney-general’s office would perform their roles in Anwar’s case ina fair and transparent manner.
“The charges leveled against Anwar provide the government a convenient distraction from current political crises,” said Adams.
”Pursuing this case will only undermine the credibility of the police, the prosecutor and the government.”

The sodomy charges were filed under an antiquated law, a holdover from British colonial rule, that criminalizes “carnal intercourse against the order of nature,” both consensual and non-consensual. Human Rights Watch opposes all laws used to criminalize consensual homosexual conduct between adults, and urged the Malaysian authorities to repeal those provisions while replacing those on non-consensual sexual acts with a modern, gender-neutral law on rape.
Anwar’s previous trials in 1999 and 2000 on corruption and sodomy charges raised serious concerns about judicial independence and fairness.
The courts refused bail, prevented Anwar from raising certaindefenses, disallowed witnesses from testifying, and improperly threatened defense lawyers with contempt proceedings. Then-Prime Minister Mohamad Mahathir even went on television during the trial to declare Anwar guilty.
If the charges are not dropped, trial proceedings should be fair and public, and conducted by an independent, impartial and competent court that meets international due process standards, HumanRights Watch said. This includes selecting the judge at random according to the standard practice in Malaysia. There should be no shadow of suspicion that the selection of the judge was fixed, as inthe previous trials.
