Persepsi Rakyat Terhadap Kerajaan TTG Kematian Beng Hock - Apa kata Ku Li

Mr Teoh Beng Hock’s death marks a watershed in the attitude of the public towards their government. The government has plumbed a new low in loss of credibility. Many people have come up to tell me in anger or despair that they feel their country has gone off the rails. People who previously considered themselves apolitical have been roused into active engagement.

There have been too many deaths under custody. But this death is particularly disturbing because Mr Teoh died after interrogation by a specially commissioned watchdog agency, inaugurated with fanfare last year by the outgoing administration. The very agency set up to combat the abuse of power has become in the public eye a symbol of the abuse of power.

Mr Teoh was a mere witness. He was questioned about the possible misuse of funds by his employer, a state assemblyman, to buy flags for the last Merdeka celebrations. The sum in question was RM2,400. He was questioned for eight hours through the night. He was found dead the following day outside the MACC’s headquarters.

Mr Teoh, 30, would have registered his marriage last weekend. His fiancée is two-months pregnant.

If the Perak debacle reminded us of the importance of the Constitution, the death under suspicious circumstances of Mr Teoh Beng Hock has brought home in a heart-wrenching way how much we need our public institutions to be independent and law-abiding. A shocked public is demanding answers, and rightly so.

Questions about how Mr Teoh died cannot be shut down with the usual warning that it is “liable to confuse the public” because the public is already confused. We are confused about how an idealistic young man with everything to live for can enter the headquarters of the Malaysian Anti-Corruption Commission as a witness one day and be found dead outside the next.

Questions about the death of Mr Teoh cannot be swept aside with the paternalistic instruction to “leave it to the authorities to investigate,” because the death of Mr Teoh appears to be just the result of “leaving it to the authorities investigate.” It is precisely the independence of the investigating authorities that people are questioning.

Questions about the death of Mr Teoh cannot be suppressed with the warning “not to speculate” when the investigating authorities were apparently able to prognosticate, ahead of their own investigations, that foul play was not involved, and some leaders appear to have special knowledge that Mr Teoh jumped to his death of his own accord.

Questions about the death of Mr Teoh cannot be evaded with the low tactic of racializing the issue because the death of Mr Teoh touches us all as citizens, brothers and sisters and fathers and mothers. None of us wants to live under a government apparatus that cannot be trusted to be independent and to tell the truth.

Questions about the death of Mr Teoh cannot be suppressed with authoritarian prohibitions because they are about the integrity and independence of institutions that belong to the people. Those ministers who talk down to the people may have forgotten who put them into government and pays their wages, and whose questions they were put there to ask. And to answer.

To ask such questions is not to “politicize” the issue but to exercise our ownership of an issue that touches each and every one of us as citizens: our basic institutions are rotted out, and we are headed down the path of a failed state.

It is our right and indeed our duty as citizens to keep asking questions when someone dies under circumstances that put the entire government under a shadow. As we ask these questions let us accept our joint responsibility to push uncompromisingly for an overhaul of the key institutions that have rotted through under exactly the kind of authoritarianism that would prohibit discussion of the circumstances of the death of Mr Teoh Beng Hock.

Ayo yo!! Selamatkah Lebuhraya LDP-Puchong?

Lebuhraya Damansara-Puchong, Puchong Jaya interchange -Major Cracks Found!!!

Corrective action: To Conduct Condition Assessment on Bridges Located along Lebuhraya Damansara-Puchong by Evenfit Consult.


Major crack lines found underneath the bridge!

I bet that not much people take this seriously (except the concessionaire) although thousands were using this bridge everyday either through the top or passing underneath it.
The possible reason is that these defects do not causing anything fall down (yet).

The crack locations and widths are summarized in this figure. There are 2 rows of bridges running parallel throughout that supported by abutments at both ends , and 11 rows of piers in between.

For clarity, each space between supports (span) are labelled and colored. The U-turns and roads underneath the bridge are shown as well. From here, you can see how lucky was the owner that all defected parts are just nicely not above the road. That's why this issue were never brought up to newspaper.

Let's see some pictures taken on 21 June 09.

At 12th span, the whole stretch of soffit cracks. The crack lines have been filled by something by bridge repair company that makes them so obvious.

12th span: You can see the crack width marked by the bridge repair company. One of them is 1.5mm

11th span: The crack lines in 11th span are spreading out from its mid span and they are not as widespreaded as the end (12th) span.

10th span: Crack width 2.1mm
10th span: Except these funny marks that doesn't looks like structural crack, I couldn't see any crack line marking here. I also can not find any crack line by nake eye through 4m height distance. But, please help me to remember that this span does not crack on 21 June 09, this information could be useful one day in the future.

5th to 9th span: Nothing special found

4th span: Some more crack lines found and they are "still young" compared with others.

Before showing you some even more
suprising pictures, please allow me to share some information on how may a civil engineer look into the cracks.

The easiest way to assess the seriousness of this problem is to compare the crack width with the allowable one in the code of practice --- it is 0.3mm
So now you see:
0.3 vs 1.5 (12th span), 2.1 (10th span) ---- 5 to 7 times the allowable crack width.
What does it means?
The reinforcement steels are now exposed to corrosion. After sometime, when the reinforcements cross sections are largely rusted to the extend that the remains are incapacle to withstand the tension force anymore, they will yield, or just snap off.
Not serious enough?
Let's go further down. This may need some effort to understand.
Steel elongation limit: There's a requirement on the steel bar elongation limit. For high yield deformed bar (don't bother with this jargon, just treat it as steel bar), the first limit is 0.2% and the fatal limit is around 12%.
The 0.2% elongation indicates a point where the strain is permanent. For example:
-You pull a 1m long bar to 1.001m (the elongation is 1mm, the strain is 0.1%) then release, the bar shrink back to 1.000m. The strain is not permanent.
-You pull the same bar to 1.005 (elongation = 5mm, strain is 0.5% which is exceeding 0.2%) then release. The bar does not shrink anymore or just shrink a little, e.g. 1.004mm or 1.0045mm, which is permanent. Once you apply the same force to it again, it will go further.
If you keep pulling the 1m bar to 1.12m (12%), the necking will appear and prepare to listen to a big bang sound --- the steel snapped.

Where are we now?

We have gone through some critical requirements. So, what is the steel elongation of the bridge? Is it less than 0.2%, between 0.2% and 12% or has already exceeded 12%? Please allow me to do some pluck-from-the-sky since I can't count exactly how many crack is there:
-Assume the 12th span is 30m (believe me, the owner prefer me to assume it as long as possible for the following calculation)
-Assuming there's 300 cracks across the span, each of them are 0.5mm (compared with 1.5 shown in the figure, I've discounted alot)
Then, elongation of the bottom bars is now 300*0.5 = 150mm
Strain = 150/30000 = 0.005 or 0.5%, Oops, these bars are now on the way to the hell (>0.2%). Every overloaded truck passing on top of it will induce additional elongation to it, no return.

The 1st span: DALANG!!!! It's 8.65mm!
Say there's 100 cracks with average width of 3mm, and the span is 30m, what is the strain now? (10%)

How about assuming 4mm crack width? (13.33%, fatal)
How about the span is 25m instead of 30m? ...
How about....

So, why this bridge is still standing?

Because, it is not solely rely on the reinforcement. Supposingly, this is a post-tensioned bridge. The tendons may still playing their role on sustaining the bridge from breaking down, but they are now unable to sustain the bridge from crack badly.

By assuming it as a post tensioned bridge, the following may be the reasons causing these crack:
1) Underdesign
2) Underprovided prestressing force
3) Inappropriate input of design parameters e.g. material properties, creep coefficient.
4) Out of tolerance in construction
5) Act of god (most of politicians like this one)

So now comes to the final question: is it safe?
It depends on who say it.
For me, I will try to avoid using it for this moment.
For the owner, it is subject to the appraisal report of the bridge repairing company.
For the bridge repair company... I can feel that they are now like a sardin between their paymaster and the public. I hope that they are able to convince me to use the bridge again.
For the politicians... I don't know. But I recalled the MRR2 series in my mind now.

Alahai SPRM - Exco Sngor Cepat diSiasat,ADun BN habiskan 27juta?

Apa status kes 54 Adun BN Selangor habiskan RM 27 juta?


Jaraknya tidak sampai setahun selepas peristiwa kematian A.Kugan semasa di dalam tahanan polis, rakyat sekali lagi dikejutkan dengan tragedi ngeri kematian misteri Setiausaha Politik Exco Kerajaan Negeri Selangor, Teoh Beng Hock.

Beng Hock dilaporkan ditemui mati di koridor luar tingkat lima bangunan plaza Masalam di Shah Alam selepas disoal siasat Suruhanjaya Pencegahan Rasuah (SPRM) berhubung isu penyalahgunaan wang peruntukan melibatkan beberapa Adun Pakatan Rakyat negeri Selangor.
Tragedi tersebut menggamit pelbagai persepsi tidak menyenangkan terhadap pihak berkuasa tempatan. Di mana piagam kerajaan dalam menjamin keselamatan suspek semasa menjalani proses siasatan?

Apatah lagi siasatan ke atas Beng Hock dilihat agak luar biasa apabila memakan masa terlalu lama (kira-kira 10 jam). Modus operandi itu secara tidak langsung menimbulkan unsur penderaan mental sekaligus bersalahan dengan etika hak asasi manusia.
Justeru, tidak ada cacatnya desakan agar Suruhanjaya Diraja ditubuhkan kerana tragedi tersebut memberi kesan besar kepada iltizam rakyat yang ingin melihat sesuatu perkara itu dari sudut keadilan.

Tindakan mengunci suara mana-mana individu yang cuba melontarkan pandangan atau pendapatnya terhadap perkara yang berlaku menggambarkan bayangan seram pemimpin kerajaan cuba menyembunyikan kemungkaran di sebalik telunjuk sendiri.

Tidak mampu! Bahkan bertentangan dengan prinsip demokrasi negara.

Perspektif kerajaan adil tidak menepati kretirearnya selagi hak kebebasan rakyat bersuara masih diganggu-gugat dengan sekatan atau ugutan. Konsep 1Malaysia rakyat didahulukan, hanya sia-sia jika gagal mencipta satu dimensi baru secara keseluruhan buat rakyat.

Kalau Menteri di Jabatan Perdana Menteri, Dato' Seri Mohd Nazri Abdul Aziz, sendiri boleh berspekulatif, kematian mangsa berpunca dari terjun bangunan, kenapa tidak dibolehkan rakyat turut berspekulatif ia adalah dari kejahatan SPRM berdasarkan kaitan 'environment'.

Sebelum ini, beberapa orang penyokong Dato� Norza Zakaria, calon Majlis Tertinggi Umno telah membuat laporan polis bahawa mereka telah didera dan diseksa oleh SPRM semasa soal siasat dilakukan ke atas mereka berkaitan rasuah melibatkan Norza.

Justeru cadangan penubuhan Suruhanjaya Diraja bukan menjurus kepada satu aspek tragedi kematian Beng Hock, tetapi apa yang lebih jauh dari itu ialah tahap keintegritiannya terhadap sesuatu kes.

SPRM mula beroperasi secara rasmi pada 1 Januari 2009. Sebelum ini dikenali sebagai Badan Pencegah Rasuah (BPR) Malaysia. Ditubuhkan melalui penggubalan Akta Suruhanjaya Pencegahan Rasuah Malaysia 2008 (Akta 694).

Ia ditubuh bagi meningkatkan keberkesanan dan kecekapan dalam usaha pencegahan rasuah serta memperbaiki persepsi kebebasan dan ketelusan dalam pelaksanaan fungsi-fungsi suruhanjaya.

Sebaliknya hari ini SPRM dilihat gagal membuktikan peranannya menyebabkan ramai orang mempertikaikan kredibilitinya seolah-olah mengamalkan polisi 'double standard'.

Jika Beng Hock bersama Adun-Adun Pakatan yang lain SPRM boleh seagresif itu dalam menjalankan siasatannya, tetapi kenapa tidak terhadap beberapa pemimpin BN yang telah diketahui umum terlibat dalam penyalahgunaan kuasa dan rasuah bernilai jutaan ringgit?

Sebagaimana kes berlaku di Selangor sebelum pilihan raya umum 8 Mac 2008 melibatkan wang peruntukan Adun BN yang berjumlah RM500,000 dihabiskan dalam tempoh 50 hari merangkumi jumlah keseluruhan (54 Adun) sebanyak RM27 juta?

Dan kemana hilangnya aduan terhadap individu terbabit dengan skandal Zon Bebas Pelabuhan Klang (PKFZ) bernilai RM12.5 bilion, serta istana bekas Menteri Besar Selangor, Datuk Seri Khir Toyo, mencecah RM24 juta melebihi pendapatan asalnya di samping lawatannya ke Disneyland yang menelan belanja hampir RM1.8 juta.

Ringkasnya, ke mana pergi laporan demi laporan mengenai penyalahgunaan kuasa pemimpin BN tidak dipedulikan SPRM? Rakyat menuntut jawapan tegas tanpa sebarang unsur politik.
Kegagalan SPRM berbuat demikian bermakna SPRM telah mencalar polisi kebebasannya sendiri yang boleh dianggap penubuhannya adalah semata-mata untuk menjadi kuda tunggangan Umno-BN bagi melemahkan kerajaan Pakatan Rakyat.

Penyelewengan Beasr Dalam Kes Anwar

10 PENYELEWENGAN BESAR PENDAKWAAN DALAM KES ANWAR

Penyiasatan dan pendakwaan ke atas Anwar Ibrahim telah menimbulkan pelbagai persepsi dan spekulasi. Meskipun Anwar Ibrahim belum di dakwa secara rasmi di mahkamah, terdapat pelbagai kepincangan dalam siasatan dan dalam perjalanan kes ini. Berikut ialah 10 perkara misteri dan luar biasa yang timbul dalam kes Anwar.

1. Laporan Pengadu enggan diserahkan
Ini merupakan satu perkara yang luar biasa. Lazimnya, apabila seseorang yang dituduh dengan sesuatu kesalahan meminta laporan polis yang dibuat oleh pengadu, ianya akan dibekalkan dalam masa seminggu ke dua minggu oleh pihak polis. Tanpa laporan pengadu, orang yang tertuduh sukar membela diri kerana apa yang didakwa pun tentulah tidak jelas. Pengalaman penulis memohon laporan polis bagi membela anak guam membuatkan penulis hairan kerana penulis pernah beberapa kali mendapat laporan pengadu pada pagi yang sama penulis memohon. Kenyataan Hamid Albar bahawa laporan enggan diberi kerana pendakwaan belum dimulakan secara rasmi tidak masuk akal kerana masyarakat maklum Anwar telah ditahan oleh polis, keterangannya telah diambil dan beliau perlu membela diri dan reputasinya. Ini meyakinkan masyarakat bahawa laporan polis belum ada dan perbincangan sedang dibuat berhubung inti laporan tersebut untuk mendapatkan tarikh dakwaan yang paling sesuai.

2. Anwar ditangkap sebelum tempoh
Adalah sesuatu yang cukup memalukan apabila pihak polis memungkiri janji dan menangkap Anwar sebelum tempoh yang diberikan tamat. Tempoh diberi sehingga pukul 2 petang tetapi Anwar ditangkap sekitar pukul 1 petang. Mungkin polis terbawa-bawa sikap Pak Lah yang kerap membuat kenyataan palsu.

3. Anwar disabitkan bersalah sebelum dibicarakan
Apabila Pak lah diminta mengulas berhubung kes Anwar, Pak Lah dengan segera berkata bahawa memanglah penjenayah akan menafikan kesalahannya. Belum pun perbicaraan bermula, Anwar sudah disabitkan sebagai pesalah oleh Pak Lah. Pada masa yang sama, apabila Pak Lah diminta mengulas berhubung dakwaan ke atas najib dan Rosmah, Pak Lah dengan segera menyatakan bahawa Pak Lah berkeyakinan penuh bahawa Najib dan Rosmah tidak bersalah. Jika Mahathir dikaitkan dengan konspirasi perlantikan hakim, pak Lah selangkah ke hadapan dengan melantik dirinya sebagai hakim tidak rasmi.

4. DNA baru Anwar diminta oleh Pak Lah dan Khairi.
DNA Anwar sudah lama dimiliki oleh pihak polis berikutan siasatan kes lamanya. Paten DNA tidak akan berubah. Justeru DNA baru tidak diperlukan melainkan jika hendak digunakan sebagai bukti palsu yang hendak dicalit dibadan pengadu. Tindakan Khairi dan Pak Lah yang berulangkali menuntut Anwar memberi DNA barunya menimbulkan tanda tanya berhubung tujuan mereka. Apabila Anwar mendedahkan perkara ini di dalam muka depan Suara Keadilan, Pak LAh dan Khairi diam membisu. Kalau anak dara yang diam, ini bermakna anak dara tersebut setuju dengan pinangan. Justeru, diamnya Pak LAh dan Khairi seakan mengiyakan persepsi masyarakat bahawa inilah tujuannya.

5. Laporan Pusrawi
Perlu diakui bahawa laporan Pusrawi sebelum ini bukanlah laporan rasmi bagi kes Anwar. Meskipun begitu, fakta bahawa seorang doktor, meskipun bukan doktor pakar kes liwat, telah melihat lubang punggung Saiful dan tiada sebarang kesan koyakan atau apa-apa tanda diliwat adalah relevan. Meminjam istilah yang selalu digunakan di dalam kes-kes berkaitan Puspakom, pemeriksaan yang dibuat adalah pemeriksaan mata kasar. Meskipun begitu, ianya tetap relevan dan keterangan sudah cukup untuk menimbulkan keraguan munasabah. Pejabat Peguam Negara selama ini tidak membuat pendakwaan melainkan yakin dengan tahap 90% bahawa tertuduh memang bersalah dan bukti-bukti yang ada benar-benar kuat.

6. Bukti alibi Anwar memadai
Kepincangan dalam kes ini semakin menjadi-jadi apabila pihak polis berkeras meminta DNA baru Anwar sedangkan bukti alibi Anwar tidak dikaji. Sepatutnya, polis menyerahkan laporan Saiful kepada Anwar supaya Anwar boleh membela diri dengan menjelaskan di mana Anwar berada pada tarikh yang didakwa Saiful berlaku liwat tersebut. Seterusnya, alibi Anwar perlu disiasat. Sebagai contoh, Antihusam (blogger UMNO) mendakwa punggungnya telah saya liwat pada pukul 11 malam , 20 Julai 2008 di Hotel Sunway. Saya akan memaklumkan bukti alibi saya pada waktu itu. Contohnya, saya menyatakan bahawa pada waktu tersebut, saya menghadiri ceramah Ustaz Hadi di markas Pas. Terdapat lebih 20 kawan saya yang boleh membuktikan kehadiran saya. Justeru, mustahil saya meliwat Antihusam. Apabila pihak polis selesai menyoal alibi-alibi saya dan berpuas hati bahawa saya mustahil meliwat Antihusam, siasatan patut ditamatkan. Begitulah juga dalam kes Anwar. Tindakan pihak polis yang beria-ia mahukan DNA baru Anwar kelihatan senada dengan Pak Lah dan Khairi.

7. Pendakwaan oleh Pejabat Peguam Negara
UMNO ke sana ke sini membuat kenyataan bahawa kes Anwar tidak akan diuruskan oleh Pejabat Peguam Negara kerana Peguam Negara sendiri sedang disiasat berhubung dakwaan rasuah dan penyelewengan kuasa yang dibuat oleh Anwar. Pendakwaan, jika jadi, akan dibuat oleh Peguam Cara Negara. Masyarakat sedia maklum bahawa pendakwaan masih akan diteruskan oleh Pejabat Peguam Negara sekalipun diketuai oleh Peguam Cara Negara. Adalah pelik bin ajaib untuk mendakwa Pejabat Peguam Negara tidak akan dipengaruhi oleh Peguam Negara. Nama pun Pejabat Peguam Negara.

8. Laporan HKL
Timbul isu terbaru bahawa laporan rasmi HKL turut bocor dan laporan tersebut menyatakan bahawa Saiful memang tiada tanda-tanda diliwat dan mustahil Saiful diliwat. Ini menunjukkan Saiful tidak ikhlas membantu BN. Sekiranya Saiful komited membantu BN, Saiful sepatutnya pergi ke Lorong Haji Taib dan menyuruh pondan-pondan di situ meliwatnya beberapa kali agar kesan liwat ketara. Ini menunjukkan perancangan lemah BN dan ketidak ikhlasan Saiful dalam membantu BN.

9. Isu motif dan tujuan
Kes ini menimbulkan keraguan yang cukup banyak apabila kepimpinan UMNO seperti Najib mengakui telah berjumpa dengan Saiful sebelum saiful membuat laporan polis. Adalah menjadi pengetahuan umum bahawa Anwar adalah musuh politik UMNO. Justeru, polis sepatutnya menyiasat kebarangkalian berlakunya konspirasi dikalangan UMNO untuk menganiayai Anwar seperti yang pernah dibuat sebelum ini. Sebelum ini, mahkamah telahpun membebaskan Anwar dari tuduhan liwat yang dijaja oleh UMNO berdasarkan sekeping surat layang.

10. Terlampau banyak percanggahan fakta kes oleh BN
Pada mulanya, Najib mendakwa tidak pernah berjumpa Saiful. Kemudian, Najib mendakwa pula bahawa najib pernah berjumpa Saiful 2 bulan dulu di pejabat untuk membincangkan biasiswa. Kemudian, Najib berkata pula bahawa Najib telah berjumpa Saiful 2 hari sebelum laporan polis dibuat untuk membincangkan biasiswa. Tiba-tiba, Najib mendakwa pula Najib telah memegang tangan Saiful yang kesejukan 2 hari sebelum laporan polis dibuat di rumah Najib sendiri apabila Saiful yang kononnya ketakutan datang mengadu diliwat.

Saiful pula mulanya mendakwa diliwat pada 26 haribulan di sebuah kondo di Malaysia. Apabila Anwar kelihatan mempunyai bukti alibi yang kukuh, saiful menjadi terdesak. Kemudian, Saiful menyatakan pula bahawa dia telah 3 kali menemani rombongan Anwar ke luar negara dengan memberi “hint” bahawa dia kononnya telah diliwat-liwat di luar negara beberapa kali. Ini menimbulkan pelbagai tanda Tanya. Mengapa seorang lelaki yang kelihatan tinggi dan sihat seperti Saiful membiarkan dirinya diliwat-liwat beberapa kali dan terus menemani Anwar ke mana saja. Sebagai contoh, jika saya diliwat oleh sesiapa, saya akan trauma dan akan segera menjauhkan diri dari orang tersebut.

Selain itu, Saiful juga sentiasa kelihatan ceria. Demi Allah, selama saya bekerja sebagai peguam, belum pernah saya menemui mangsa rogol atau mangsa liwat yang begitu ceria. Mangsa kes serangan seksual akan trauma, malu dengan masyarakat, rasa rendah diri dan biasanya mengalami kemurungan.

Saiful juga seorang lelaki. Tidak semudah itu hendak menembusi lubang punggung seorang lelaki. Asalkan saiful mengeraskan punggungnya, mustahil Anwar dapat meliwatnya. Sekiranya Saiful benar-benar hendak diliwat, dua atau tiga orang lelaki gagah diperlukan untuk memegang Saiful dan lubang punggung saiful perlu disapu minyak terlebih dahulu sebelum diliwat. Sekiranya ini yang berlaku, mustahil Saiful akan terus mengikut Anwar ke sana sini sehinggalah menemani rombongan Anwar ke luar negara sebanyak 3 kali.

Sebagai kesimpulan, kes Anwar Ibrahim ini tidak layak dibawa ke mahkamah untuk pendakwaan. Sekiranya saya ialah hakim bagi kes tersebut, saya akan melempar fail pendakwaan ke lantai kerana terlalu banyak kepincangan.

Former Bar Council President - Not Another Anwar Prosecution!

We cannot afford another Anwar Prosecution

THE Datuk Seri Anwar Ibrahim prosecution is seen by many as the political persecution of the leader of the opposition. The question is, can we, as a nation, go through a second Anwar prosecution?

Lawyer Tommy Thomas had this to say in an article titled A Second Prosecution of Anwar Ibrahim — Is it in the national interest?: "The starting point is the previous prosecution of Anwar for sodomy in 1998[,] which imposed incredible strains on our legal system, and made Malaysia the laughing stock in the legal world.

"It would be sufficient to remind ourselves of the conduct of the prosecution in the 1998 case, the unfair publicity given by the mass media, the denial of bail, the 'irrelevant' rulings by the trial judge, the conduct of the trial itself, the amendment of the charges, the shameful parading of the mattress, the expungement of 'inconvenient' evidence, the finding of guilty, the lengthy sentence, the appeal to the Court of Appeal, and finally the appeal to the Federal Court."

I personally recall being utterly horrified and disgusted by the charges against Anwar the first time round. The initial charges carried wording I cannot repeat in good company. I also remember the terrible injustice done to Sukma Darmawan. And then to Dr Munawar Ahmad Anees, who to this day has not been vindicated by our courts although they have had the opportunity to do so. We must not forget these and other unfortunate people who all became innocent victims in this political war against Anwar.

The whole prosecution was a disgrace. I remember someone saying then that the trial robbed this country's citizens, in particular our children, of their innocence, as we had a daily fare of sodomy, semen-stained mattresses and the like.

Thomas argues, and I agree, that since those disgraceful events, the judiciary has taken steps to repair itself. He argues that a second prosecution would (I'd say could because, of course, the court could throw out the case) undo all the repair the judiciary has carried out to improve its image.

And it is no coincidence that Anwar is the opposition leader who has brought sweeping changes to the political landscape.
Tommy ThomasThomas argues: "If Anwar were not a potential prime minister, and only an ordinary citizen, he would not face this prosecution. It is as simple, plain and obvious as that."
The prosecution, Thomas argues, is economic and political suicide. He adds that the people of Malaysia are deeply divided on this issue, and that Malaysia's international image will, no doubt, suffer.

He then concludes with these words: "History is replete with examples of leaders who refused to learn from past mistakes, and were doomed to repeat them. It would be a tragedy of ancient Greek proportions if our leaders do not learn the lessons from 1998.

"It is abundantly clear that all the factors point in one direction: it is not in the public interest to subject the nation and its citizens to the trauma of a second trial..."

Ultimately, the powers-that-be must appreciate the consequences of this prosecution. If they win, they lose; if they lose, they lose. Actually, the nation loses. If you were a betting person, what would you do with those odds?

One thing must be made clear, it is my opinion that what we are doing to Anwar Ibrahim is starkly similar to what is happening to Aung San Suu Kyi. I ask, show me the difference between the two. I ask, how can we condemn the latter and do the former?

I call on the government to immediately review the Anwar prosecution in the public interest and because it is the right thing to do. If the government takes this step, it will certainly regain some credibility.

The AG's role
It is important in our justice system to appreciate the duties and responsibilities of the Attorney General, particularly in criminal prosecutions.

The Attorney General cannot act arbitrarily. In a judgment relating to the Attorney General's discretion over prosecutions, the Federal Court held that:

"The public of whose interest he [or she] is the guardian has a right to expect him [or her] to act honestly, without fear of powerful national and local figures or of the consequences to him [or her] personally or politically, and without favouring his [or her] relatives and friends and supporters, his [or her] principal concern being to maintain the rule of law so that there will be no anarchy and to maintain standards in public life and the private sector."

Aung San Suu Kyi (Public domain; source: Wiki commons) Our institutions must work to regain their credibility. I started my speech with a quote from Aung San Suu Kyi that fear of losing power corrupts those who wield it. I hope this is not what we are seeing today in Malaysia.

Rule of law
You would have appreciated by now that democracy, rule of law and human rights are all interlinked. The essential distinction between rule of law and rule by law must be noted.
Many dictatorships or military regimes can quite honestly say that everything that they do is in accordance with laws they have passed. Does our Internal Security Act, for example, accord with the rule of law? No — that is rule by law.

Laws passed by Parliament must accord with the rule of law. They must encompass basic fundamental liberties and values. These laws must be acceptable to a large number of people. They must be fair.

In Malaysia, even after 50 years of Merdeka, there are still in existence four declarations of emergency! We still have the archaic Sedition Act, Official Secrets Act, and Printing Presses and Publications Act. It is time for us to review all these pieces of legislation.

Within our borders
So, if there are human rights abuses outside our borders, can we in today's world fail to act? The answer is no. We must reach across our borders on issues of human rights.

But more important is what we do within our borders. Do we have the right to condemn apartheid, as we did, when we allow racist rhetoric to abound in our country? What about the right to condemn Aung San Suu Kyi's suffering while we treat Anwar Ibrahim the way we do? Can we criticise the kidnapping and disappearance of people overseas when it happens in our country?

We must have the moral authority to criticise others by ensuring we do not behave in the same way.

Najib....Najib... ADa yang Tak Kena?


Tuan Guru Nik Aziz - Dah Tiga Bulan Najib Jadi PM, Ada Yang Tidak Kena


“Kita telah masuk ke bulan ketiga sejak pelantikan Perdana Menteri yang baru. Kalau itulah ukuran sambutan orang terhadap Perdana Menteri yang baru maka sudah tentu ada sesuatu yang tidak kena.”

Demikian pandangan Mursyidul Am PAS, Tuan Guru Dato’ Nik Abdul Aziz Nik Mat dalam satu wawancara bersama Harakah baru-baru ini.

Menurutnya, ukuran Dato’ Seri Najib Tun Razak sebagai Perdana Menteri baru boleh dilihat berdasarkan sambutan masyarakat terhadapnya termasuk dunia luar.

“Dalam ukuran kepada populariti Perdana Menteri yang baru, kalau kita ambil daripada kaca mata “ucap tahniah” yang diterima oleh Malaysia, setakat ini yang saya diberi faham hanya Singapura, Brunei, dan baru-baru ini Amerika yang ucapkan tahniah. Hanya tiga pemimpin negara dari seluruh dunia yang menyampaikan ucapan tersebut.

“Kita telah masuk ke bulan ketiga sejak pelantikan Perdana Menteri yang baru. Kalau itulah ukuran sambutan orang terhadap perdana menteri yang baru maka sudah tentu ada sesuatu yang tidak kena,”jelasnya.

Tambah Nik Aziz, jika diselidik,sudah pasti pergolakan bukan sahaja dalam komponen Barisan Nasional (BN) malah isu dalaman Umno sendiri boleh dianggap sebagai punca pelantikan Najib sebagai Perdana Menteri tidak diterima dengan baik.

“Apa agaknya yang tidak kena, jelaslah pergolakan dalaman seperti isu PPP dengan elemen dua presiden antara Murugiah dengan Kayveas belum lagi selesai.

“Begitu juga dengan perpecahan di Terengganu antara blok Ahmad Said dengan Idris Jusoh, laporan ancaman bunuh ketika hendak hadir mesyuarat sidang dun masih belum selesai,”jelasnya lagi.

Nik Aziz juga menerangkan, bukan sahaja satu atau dua perkara tetapi ia juga melibatkan hampir seluruh negara seperti,”di Pulau Pinang sendiri pun, usul tidak terima kepada kepimpinan majlis perbandaran menolak salah satu. Itupun ia masih dalam keadaan yang hangat.

“Jika kita tinjau di Perlis, keadaan yang hampir serupa. Di wilayah ini, keadaannya sama, orang yang boleh diharap dalam menyokong Najib hanya dua, tiga orang sahaja. Mungkin dia bekas setiusaha politik dia, Zahid Hamidi dan mungkin seorang lagi yang baru dilantik sebagai Senator. Selain mereka, saya lihat masih berkecuali dan kemungkinan tidak memberi wala’ kepada Najib.”

Dalam pada itiu katanya, desakan oleh pemimpin DAP, Lim Kit Siang agar Najib diuji di parlimen untuk melihat wujud sokongan atau tidak juga antara indikasi bahawa kepimpinan Najib benar-benar bermasalah.

“Sebab itu desakan yang ditimbulkan oleh Lim Kit Siang berasaskan kepada 45 peratus sahaja undi popular yang diperolehi. Najib sepatutnya diuji dalam sidang dewan yakni ‘vote for non-confidence’.

“Kenapa ini tidak boleh dibuat? Ini perkara yang boleh dinilai tahap kekukuhan Umno buat masa sekarang ini,” tegasnya.

Zahid to Play a Meanigful Role in PKR

KUALA LUMPUR, June 15 — Maverick politician Datuk Zaid Ibrahim is determined to play a meaningful role in PKR and help make Pakatan Rakyat (PR) a strong alternative to Barisan Nasional (BN).

Zaid, who officially joined PKR on Saturday, said that he envisions a more democratic Malaysia where the people — and not the elites — would be in the driver's seat.

"I want people to have a choice," he told The Malaysian Insider today.

Zaid's membership is widely seen as a boost to PKR as some even perceive him to be prime minister material.

The former Kota Baru MP, however, denies having any ambitions to be prime minister. "I just want to do my bit," he says.

What he wants to do is help PR become more cohesive and hopes that the opposition coalition's three component parties, PKR, PAS and DAP will agree to the creation of a formal coalition secretariat as well as agree to share resources.

"The secretariat will try and find common positions on delicate issues and strengthen capacity building," Zaid said.

He said that he wants to play a role in the secretariat and his top priority would be to put in place a structure where the parties would have to meet regularly.

"I want to introduce a system so the parties can meet on a more formal basis and find common ground," he said.

Asked if he has any idea yet on how to handle "delicate issues" that may cause friction between the PR partners, Zaid replied that the coalition is still new and formed from diverse historical backgrounds.

"What is clear is that they have done well to stay together," said Zaid.

He shares that some questioned his decision to join PKR, a party which they perceive as weak, but he says that he sees in PR a huge opportunity.

"We cannot allow this country to go on like it has. Those in Umno keep harping on the past and justify their actions based on what happened many decades ago. But if you keep talking about the past when can we move forward?" he said.

"I hope more will join PR. Malaysians must believe they have a role to play. That is why I joined PKR."

Zaid had also toyed with the idea of joining PAS or DAP but in the end decided that as PKR was younger, he felt he could contribute more.

"The other parties are more mature. PKR is easier to change and the potential is a lot more," he said.

Rakaman video ini melibatkan pejabat kehakiman tertinggi dalam konspirasi untuk mempengaruhi perjalanan sistem keadilan negara. Ia melibatkan campurtangan seorang peguam yang penuh dengan kontroversi dari sejarah penglibatannya dalam perkara yang menimbulkan syak wasangka dan seterusnya membawa kepada skandal yang melibatkan perlantikan hakim-hakim negara.

Pada tahun 1994, satu gambar menunjukkan VK Lingam dan Ketua Hakim Negara ketika itu Tun Eusoffe Chin cuti bersama di New Zealand dalam situasi yang melampaui tatasusila professional dan pengendalian yang tidak beretika Ketua Hakim tersebut. Lingam juga terlibat dalam laporan audit skandal Perwaja Steel oleh PriceWaterhouseCoopers yang dibentangkan di Parlimen yang melibatkan kerugian berbillion ringgit wang rakyat.

Dalam video ini, Lingam dirakam berbicara dengan Ketua Hakim Negara, Tun Ahmad Fairuz Abdul Halim di mana nama saya, antara lain, disebut secara khusus.

Perbicaraan tersebut adalah dalam konteks konspirasi untuk mempengaruhi lantikan hakim kanan dan campurtangan badan kehakiman. Oleh itu, kami mempunyai sebab kukuh dan percaya bahawa perbualan pada tahun 2002 ini menentukan hasil beberapa perbicaraan mahkamah penting, termasuk kes saya.

Video ini juga melibatkan Vincent Tan dan Tengku Adnan Tengku Mansor. Vincent Tan adalah seorang ahli perniagaan dan jutawan judi yang dikatakan terlibat mempengaruhi proses kehakimam dalam kes Ayer Molek. Tengku Adnan pula adalah pemimpin UMNO dan ahli kabinet yang terlibat dalam konspirasi politik untuk menjatuhkan saya pada tahun 1998.
Skandal video ini mengukuhkan dakwaan kami mengenai konspirasi politik yang melibatkan pemimpin tertinggi negara dan korupsi oleh ketua badan kehakiman. Ini membangkitkan isu mengenai hilangnya kesaksamaan perbicaraan mahkamah di negara ini. Perkara ini perlu disiasat segera demi kepentingan awam dan kami menggesa supaya satu Tribunal Bebas dibentuk segera untuk menyiasat hal yang amat memalukan ini.

Dalam hal ini, kami membuat rayuan khas kepada majlis raja-raja untuk memainkan peranan seperti yang termaktub dalam perlembagaan untuk membela hak rakyat dengan menggunakan pengaruh dalam hal-hal yang berada dalam bidang kuasa mereka.

Apa tidaknya bro.? Di Ampang sendiri telah ada seolah2 musuh dalam selimut di kalangan penguasa (PBT) yang melarang peniaga2 kecil berniaga di Kubur Kosas. Ada yang telah mula di saman. Sengaja dibuat begitu...

Teman percaya Kerajaan PR tidak zalim dibandingkan dengan kerajaan terdahulu, tetapi ada trojan horse yang sengaja mengambil tindakan drastik yang sekaligus seolah2 memperlihatkan Kerajaan PR di Ampang rakus dan tidak berhati perut. Perkara ini sudah melata diperkatakan di seluruh Bukit Indah dan Ampang Indah.

Jika ini tidak diatasi segera, ditambah dengan Najib sebagai Pengerusi Perhubungan Negeri... macam2 boleh berlaku yob!!

2. Teman pernah ke JPS Selangor, di Bangunan State Secretary baru2 ini atas urusan pejabat. Terkejut teman tengok..ditampalnya di dinding pejabat...moto kerajaan Khir Toyo. Siap warna kuning lagi..Ada berapa tak berapa ingat teman..mungkin 10 perkara..muluk2 belak....muka si tempe tupun ada..?? Hmmm...masih sayang lagi demer kat mamat ni yer?

3. State Secretary tu orang Umno biru karat yob. Teman tau sangat le...apa idaknye yob. Kalu tak silap teman pada tahun 2003 teman ada buat appointment jumpa dia pasal Bukit Indah... dah buat appointment..tak ade pulak dia pada hari yang ditetapkan. Ke mana agak2nya ye?
Ke Temerloh yob...masa tu ada wakil rakyat mati kat sana. Dia gi kempen untuk Umno. Bayangkan yob...dia tu masa tu YDP Ampang Jaya...gi kempen kat Temerloh utk Umno...apa barang?? Kuat tak kuat Umno mamat ni...??

La ni dia State Secretary. Nego dengan kerajaan pusat pasal Syabaspun dia yang head utk kerajaan negeri... Boleh pakai ke yob? Tak tahulah kalau la ni dia dah taubat lahom...(ikut kata Mat Sabu)..??

Jadi sendiri mau ingatlah yer bro..!!

Kami percaya perselisihan kecil yang digembar gembur oleh media umno-bn tidak akan meretakkan permuafakatan yang terbina dari iltizam untuk membawa Perubahan kepada rakyat Malaysia keseluruhannya.

Perlu dijelaskan bahawa isu rundingan PAS-umno yang berbangkit dari kenyataan Ustaz Abdul Hadi pada sidang akhbar selepas menyampaikan ucapan dasar di muktamar tahunan baru-baru ini harus dilihat dalam konteks pidato Presiden Pas. Dalam pidato tersebut Ustaz Abdul Hadi mengulangi komitmen PAS untuk memastikan Perubahan terlaksana melalui wadah Pakatan Rakyat dan menggariskan kewajaran muafakat antara parti bagi menyelesaikan krisis Perak melalui pilihanraya, menggesa agar badan kehakiman bebas dari sebarang kongkongan dan pilihanraya yang telus.

Inshaallah permuafakatan Keadilan, PAS dan DAP akan bertambah utuh dari hari ke hari. Rakyat Malaysia mahukan sebuah kerajaan yang bertanggungjawab, telus dan cekap mentadbir bagi kembali memacu negara ini ke persada. Pakatan Rakyat bersedia menggalas tanggungjawab demi memastikan negara ini berada di landasan yang tepat.

Kenyataan Presiden DSWA berhubung Kerajaan Perpaduan

KENYATAAN MEDIA UNTUK EDARAN SEGERA—

Saya bagi pihak Parti Keadilan Rakyat (KeADILan) merakamkan ucapan tahniah kepada Parti Islam SeMalaysia (PAS) kerana berjaya melangsungkan muktamar tahunan kali yang ke-55 di Shah Alam baru-baru ini. Syabas juga saya ucapkan kepada barisan pimpinan PAS yang baru sahaja terpilih di dalam muktamar tersebut.

Muktamar PAS tahun ini menyaksikan isu kerajaan perpaduan menjadi perhatian umum. Pelbagai spekulasi dan andaian telah dibuat oleh pihak-pihak tertentu berikutan dari ucapan dasar Presiden PAS.

KeADILan berpendirian adalah sebaiknya untuk kami menunggu penjelasan dari pimpinan PAS berhubung isu kerajaan perpaduan mahupun sebarang bentuk perbincangan dengan Umno.
Sungguhpun begitu, kami tidak menghalang mahupun mempertikaikan hasrat mana-mana pihak untuk berbincang isu-isu yang membabitkan kepentingan nasional.

Saya mengambil kesempatan ini untuk mengulangi komitmen KeADILan untuk memastikan Pakatan Rakyat sentiasa berada di dalam keadaan kuat dan utuh. Kami yakin rakan-rakan kami, PAS dan DAP juga mempunyai iltizam yang sama demi memastikan agenda perubahan terlaksana di Malaysia.

Selangor Mahu Exco dalam Port Klang Authority

Selangor wants EXCO Member on PKA Board

The Selangor government plans to place a state executive councillor on the board of directors of the Port Klang Authority (PKA) to monitor developments in the Port Klang Free Zone (PKFZ) issue.

Mentri Besar Tan Sri Abdul Khalid Ibrahim said the state government had the right to do so as one seat in the PKA board was allocated to a state government representative.

“The State EPU (Economic Planning Unit) director Datuk Noordin Sulaiman previously occupied the seat but his term expired two months ago. So, we will appoint an executive council (exco) member to the board.

“This is for us to know about the developments in the PKFZ as well as the problems and overall development in Port Klang,” he told reporters after officiating at a programme to improve Tamil school education in Selangor, here, today.

Khalid said the state government supported the establishment of the PKFZ as it could enhance international trade in the state.

He said besides that, it would also encourage the setting up of more tax-free industrial plants, hence providing more employment opportunities.

“It will also spur the development of certain industries such as the halal food industry in the area,” he added.

Asked whether the state government planned to take over the management of the PKFZ following the controversy over the implementation of the project, Abdul Khalid said: “The state government can take over provided the federal government can write off the excess development cost.”

The PKFZ which belongs to PKA and is built next to Westports in Pulau Indah, Port Klang, is meant to be a regional export hub with manufacturing activities complemented by amenities to facilitate the growth of regional distribution centres or international procurement centres.

The federal government had ordered a full investigation into the PKFZ controversy, in which the original projected cost of RM1.85 billion ballooned to RM4.6 billion amid allegations of irregularities, while the occupancy rate is low, making the integrated zone a white elephant.

Corruption and Competitiveness cannot co-exist - Tunku Aziz
Malaysia is replete with laws. You name them, and we have them. What we do not have, we produce them instantly, well, almost, in our Barisan Nasional-dominated Parliament where MPs are not encouraged to study and discuss Bills being tabled too carefully.

We also, it is claimed, have the best legal framework, rules, regulations and procedures. And we also have the Malaysian Anti-Corruption Commission, Tun Abdullah Ahmad Badawi’s afterthought farewell gift to a nation that has had to put up with decades of unbridled government corruption.

In the nature of things, it is not polite to look a gift horse in the mouth. Unlike Midas who turned everything he touched into gold, Pak Lah turned most things he touched into base metal. The MACC is a prime example of the Abdullah touch.

Even with the MACC and its new-found “independence”, we remain a thoroughly corrupt country where corruption is unofficially tolerated, and no one particularly wants to know how instant wealth is acquired. In a society such as ours where money, however obtained, is worshipped and a person with money is revered, it is not surprising that unethical public behaviour has become the norm in the corridors of power.

You do not need to take my word for it: independent international surveys, year in and year out, arrive at the same conclusion. Malaysia lags far behind Singapore, Hong Kong, Japan, Taiwan and Korea. When compared with Singapore or even Hong Kong, we are inferior on every indicator. There is, I know, at least one government agency that has undertaken a survey of its own to show that foreign surveys are biased and, therefore, unreliable. Naturally, the results are enormously flattering, but Malaysians and the world at large are more savvy than Malaysian functionaries are prepared to concede.

We are, let us not forget, dealing with well-established, professional and highly respected international survey organisations that have no rhyme or reason to show Malaysia in a bad light. The degree of unanimity among all of them, year in and year out, is remarkable.

There appears to be an official obsession to have Malaysia held up as a shining example of a country that is to be admired for its good governance, to the point of wasting large sums of money on a massive exercise in self-deception to show what great universities we have in Malaysia.

Unfortunately, this obsessive desire for greatness is not matched by the application of appropriate policies to ensure Malaysia remains competitive in global terms.

If we lose our competitive position because we are corrupt and lack integrity, we are putting our future as a nation at risk. Corruption kills competition, breeds inefficiency, distorts our decision-making processes and promotes social and political instability in the long run.

I believe that in societies where integrity is firmly entrenched, such as Singapore and Hong Kong, corruption is kept firmly under control. Malaysia has become, under successive administrations, notably the Mahathir administration, a cosy and comfortable incubator of all that is corrupt and unethical in our society.

It is not at all surprising that what began as petty corruption limited to “duit kopi” has today developed into a growth industry. It has become systemic and years of co-existing with this most debilitating of the social diseases has dulled our conscience and sense of self-worth.

Fighting corruption is too important to be left to the care and tender mercies of any government agency, let alone the MACC whose record to date has left many of us wondering whether it is not another one of Abdullah’s sick creations . It is our fight, after all, and we should keep an eagle eye on the corruption front.

We in Malaysia operate in a corruption friendly environment where corrupt practices are becoming a way of life. Our public officials, rightly or wrongly, are perceived to be on the take. Every level of the civil service, including the police, has been touch by corruption. This is not saying that every police officer or district officer is corrupt. Most are honest, decent servants of the King.
Years of Mahathirism have, however, damaged many of our important institutions.
Corruption has weakened our capacity to enforce our laws, and there is evidence of this fact everywhere — from the thousands of illegal immigrants with false documents, Mykads and work permits who know that they can work their way out of trouble by the simple expedient of “buat selesai”. We have slowly but surely lost ground to lawlessness because people employed and entrusted to carry out their duties have allowed themselves to be seduced by easy money.

It is interesting to note that the government has shown, in important law and order and corruption issues, it has no stomach to confront them decisively. Just as it is true on the implementation of an Independent Police Complaints and Misconduct commission that Abdullah surrendered to police pressure without a whimper, it is also true that what would have been an effective legal provision to call people suspected of corruption to account for their ill-gotten wealth has been deliberately omitted. The reason is not far to seek. We would need more prison space.
It is argued that there is already a money laundering Act in the law, but that is a totally different kettle of fish, and the failure on the part of the government to incorporate this provision in our laws (that Singapore and Hong Kong consider essential and have in their arsenal) smells a little fishy. I wonder if our “People’s Prime Minister” has the political will to act against the corrupt in his administration

Malaysians say Politicians the most corrupt lot


KUALA LUMPUR, June 3 — We may have voted them into office but the truth of the matter is, we don't think very highly of our politicians.

Malaysians believe that politicians are the most corrupt group, according to a global survey by anti-graft body Transparency International (TI).

In the 2009 Global Corruption Barometer (GCB), 42 per cent of Malaysians said that political parties are the most corrupt institution, followed closely by the civil service at 37 per cent.

They are also not optimistic that graft will be curbed as two-thirds of Malaysians have no faith in the government's efforts to fight corruption.

TI Malaysia president Datuk Paul Low said that this was due to the fact that the public had no idea how political parties were funded.

"Corruption in politics is the mother of all corruption. Nobody knows how they are funded. They need to eliminate money politics as well as disclose their sources of funding," he said, adding that changes in electoral laws as well as compulsory audits would be needed to reverse public perception.

However, he felt that the results may not be accurate as the survey was conducted three months ago, amid speculation of monetary inducement that resulted in the Perak political crisis as well as vote-buying in the Umno party polls.

Low also called for better accessibility to information regarding government contracts and concession agreements as well as reviewing the Official Secrets Act as "these are not strategic interests" which could compromise national security.

Malaysia regularly scores close to five out of 10 on TI's Corruption Perception Index and last November's results left it ranked 47th out of 180 countries.

Despite the move to give further powers to the national anti-graft squad when it was converted from the Anti-Corruption Agency to the Malaysian Anti-Corruption Commission (MACC), 67 per cent of Malaysians still feel the government has been ineffective in dealing with corruption.

While Low said it was still too early to judge the MACC, he acknowledged public perception was that it practised selective prosecution and must instead "take the big fish along with the small fish." TI Malaysia would also attempt to conduct a public poll on its performance later this year.
Meanwhile, of Malaysians polled, only 9 per cent admitted to paying a bribe in the last 12 months, slightly below the global average of 13 per cent. Low noted that while three out of 10 Indonesians admitted to bribery, three-quarters felt their government has been effective in fighting graft.

"We can see that the Indonesian president has become more popular so it shows people value the intergrity of politicians," he said, referring to surveys showing Susilo Bambang Yudhoyono's popularity has increased ahead of this year's presidential elections.


Globally, political parties were considered by 29 per cent to be the most corrupt followed by the civil service at 26 per cent, while on average, 56 per cent felt their governments had not tackled graft well.

Also, respondents indicated an 8 per cent increase in the perception that the private sector is corrupt. Low said that companies should take heed to the fact that 50 per cent of Malaysians said they would prefer to purchase from "corruption-free" companies.

"The private sector should introduce anti-bribery and whistle-blowing policies as well as integrity agreements," he suggested.

He also said that while he was disappointed that Malaysia has not improved its corruption index for over eight years, he was encouraged by Prime Minister Datuk Seri Najib Razak's statements on graft so far as it was early days yet in his two-month-old administration.

Low said that TI Malaysia has been consulted by the government many times before and he would be submitting a copy of this year's GCB, its sixth edition and the first with Malaysian participation, to Najib and was hopeful of further discussions with the government on the matter.

Akan berlakukah Mega Telco Broadcaster?

Ananda's Mega Telco-Broadcaster (Maxis + Astro) vs UMNO's Media Prima-Telekom


It could be for some (sinister) reasons to have this news to circulate. It is a fact that all our media and telcos owned by UMNO and cronies as well as GLCs (Telekom - Celcom).

If Ananda's Maxis merges with Ananda's Astro, it is something not impossible. The combined asset worth would be RM20 billions. Bigger than some states. Even as per now, Maxis makes millions out of Astro's stupid Akademi Fantasia.

Not sure whether Media Prima would make its move....could be partnering with Telekom or buying another telco? Media Prima is the only RTM's competitor with 4 TV channels but as with Telekom has no pay TV and satellite.

However, MEASAT is also owned by Ananda.....

Kenyataan Media Pakatan Rakyat

Kenyataan Akhbar Pakatan Rakyat 13 Mei 2009

Rumusan Pertemuan Tertutup dengan Suruhanjaya Pilihanraya

Pihak jawatankuasa Pilihanraya Pakatan Rakyat telah mengadakan pertemuan tertutup dengan Pengerusi Suruhanjaya Pilihanraya di pejabat SPR di Putrajaya semalam 12 Mei.

Rombongan Pakatan Rakyat terdiri daripada YB Dr Dzulkifli Ahmad (PAS), YB Saifuddin Nasution (PKR), YB Liew Chin Tong (DAP), YB Dato’ Johari Abdul (PKR), YB Dr Siti Mariah (PAS), YB Tian Chua (PKR), YB Manikavasagam (PKR) dan Sdr Saiful Izham sebagai penasihat Undang-undang. Rombongan kami telah disambut oleh Tan Sri Dato’ Seri Abdul Aziz bin Mohd Yusof Pengerusi Suruhanjaya Pilihan Raya Malaysia dan para pegawai kanan SPR. Antara rumusan pertemuan tersebut adalah:

1) Peraturan Pondok Panas. Kedua pihak bersetuju setelah merujuk peruntukan undang-undang bahawa proses semakan daftar pemilih di luar jarak 50 meter dari kawasan mengundi boleh dibuat oleh semua pihak. Untuk itu pihak SPR tiada halangan bagi mana-mana parti berbuat demikian.

2) Menghadkan jumlah penyokong. SPR bersetuju bahawa cadangan untuk menghadkan jumlah penyokong pada hari penamaan calon adalah sesuatu yang sukar dikuatkuasakan dan tiada peruntukan undang-undang bagi perkara tersebut. Bagaimanapun SPR menasihatkan semua parti yang bertanding agar tidak membuat kerahan bagi mengelakkan keadaan menjadi terlalu sesak.

3) Larangan berkempen. Semua pihak bersetuju bahawa semua parti tidak dibenarkan meneruskan aktiviti berkempen selepas jam 12 malam pada malam sebelum hari mengundi. Untuk itu larangan ini harus dikuatkuasakan ke atas semua parti yang bertanding. Kedua pihak juga bersetuju untuk mengadakan pertemuan berkala bagi membincangkan perkara-perkara berbangkit sekurang-kurangnya setiap 3 bulan.

Baca dan Faham!

Peguam PAS

Saya percaya ramai ingin mengetahui sama ada keputusan Hakim Mahkamah Rayuan , Dato Ramly Ali menggantung pelaksanaan keputusan Mahkamah Tinggi bermakna Zambry adalah Menteri Besar Perak yang sah ?
Sebelum saya menjawab soalan tersebut, elok rasanya saya berkongsi dengan pembaca tentang perintah-perintah yang diberikan oleh Mahkamah Tinggi pada 11 hb Mei yang lalu. Mahkamah Tinggi ketika mana membenarkan permohonan Dato Seri Nizar Jamaluddin memerintahkan seperti berikut :-

a. Berkenaan tafsiran Fasal 16 ( 6 ) Undang-Undang Tubuh Kerajaan Negeri Perak bahawa dalam keadaan di mana :

(i) Menteri Besar Negeri Perak Darul Ridzuan ingin, dan telah member nasihat, untuk pembubaran Dewan Perhimpunan Undangan Negeri Perak;

(ii) tidak terdapat pembubaran Dewan Perhimpunan Undangan Negeri Perak;

(iii) tidak terdapat usul tidak percaya yang diambil dan diterimapakai dalam dan oleh Dewan Perhimpunan Undangan Negeri Perak terhadap Mentri Besar Negeri Perak Darul Ridzuan; dan

(iv) tidak terdapat perletakan jawatan mentri besar Negeri Perak Darul Ridzuan;Mahkamah mengisytiharkan jawatan Mentri Besar Negeri Perak Darul Ridzuan ( yang dipegang secara sah oleh Nizar ) tidak boleh dan/atau tidak dikosongkan.

b. Perintah "quo warranto" dikeluarkan kepada Zambry ( Responden ) memerintahkan beliau untuk tunjuk sebab dan memberi maklumat bagaimana dan di bawah dasar atau kuasa atau authoriti mana beliau berhak kononnya memegang jawatan Menteri Besar Negeri Perak Darul Ridzuan dan kononnya bertindak dan/atau menjalankan dan/atau melaksanakan tanggungjawab-tanggungjawab, fungsi-fungsi dan tugas-tugas Menteri Besar Negeri Perak Darul Ridzuan.

c. Perintah deklarasi bahawa Zambry TIDAK BERHAK untuk dan/atau TIDAK MENJAWAT jawatan Mentri Besar Negeri Perak Darul Ridzuan dan BUKANNYA Menteri Besar Negeri Perak Darul Ridzuan pada bila-bila masa yang material.

d. Perintah injunksi untuk menghalang Zambry dan/atau agen-agen beliau dan/atau pengkhidmat-pengkhidmat beliau ( seperti Setiausaha Kerajaan Negeri ( SUK ) dari bertindak dan/atau menjalankan dan/atau melaksanakan tanggungjawab-tanggungjawab, fungsi-fungsi dan tugas-tugas Mentri Besar Negeri Perak Darul Ridzuan.

Itulah perintah-perintah yang Mahkamah Tinggi keluarkan pada 11 hb Mei yang lalu yang sekaligus menunjukkan secara jelas dan terang bahawa Dato Seri Nizar ( bukannya DS Zambry ) adalah Menteri Besar Negeri Perak yang sah.

Pada asalnya selain daripada perintah-perintah tersebut , Nizar juga memohon perintah gantirugi . Namun di atas kesedaran bahawa wang bukanlah matlamat tindakan Mahkamah ini, maka Nizar telah menarik balik tuntutan gantirugi . Jika tidak ditarik terdapat kemungkinan besar Mahkamah Tinggi juga akan menganugerahkan gantirugi kepada Nizar yang mungkin jika ditaksirkan akan mencecah jumlah yang agak tinggi.

Nizar juga tidak memohon agar Zambry perlu membayar kos kepada beliau meskipun menjadi satu prinsip undang-undang pihak yang kalah seperti Zambry perlu membayar kos kepada pihak yang menang ( iaitu Nizar ). Jika Nizar tidak menarik balik perintah kos tersebut saya boleh bayangkan ratusan ribu ringgit yang mungkin Zambry perlu membayar kepada Nizar. Sekali lagi matlamat kewangan bukan faktor yang mendorong Nizar mencabar Zambry di Mahkamah.

Sekarang saya akan menjawab persoalan yang timbul di awal artikel ini.

Permohonan untuk penggantungan pelaksanaan penghakiman ( stay of execution of judgment ) selalunya dipohon oleh pihak yang kalah dalam mana-mana prosiding Mahkamah.

Permohonan tersebut selalunya dibuat bagi mengekalkan status quo iaitu supaya pihak yang menang tidak boleh menikmati perintah yang diberikan oleh Mahkamah.

Dalam kes ini sebenarnya peguam Zambry telah pada 11 hb Mei memohon secara lisan perintah penggantungan pelaksaanaan tersebut di Mahkamah Tinggi tetapi Mahkamah telah menolak permohonan Zambry tersebut.Maka Zambry telah pada hari ini ( 12 Mei ) memohon perintah tersebut di Mahkamah Rayuan dan peguam Nizar telah membantah permohonan tersebut.

Dari segi undang-undang prinsip yang terpakai bagi permohonan penggantungan pelaksanaan adalah pihak yang memohon tersebut perlu menunjukkan dan meyakinkan Mahkamah bahawa terdapat keadaan yang istimewa atau unik ( special circumstances ) yang menwajarkan perintah yang diberikan oleh Mahkamah Tinggi tidak boleh dinikmati oleh Nizar.


Dalam kes ini nampaknya Mahkamah Rayuan berpendapat wujudnya keadaan istimewa tersebut tetapi kita masih kabur apakah yang keadaan istimewa tersebut kerana saya difahamkan Mahkamah masih belum mengeluarkan alasan penghakiman ( dan mungkin tidak akan mengeluarkan alasan ).

Selalunya jika pun Mahkamah membenarkan perintah penggantungan pelaksanaan Mahkamah akan juga dalam masa yang sama mengenakan syarat-syarat tertentu. Peguam Nizar meminta Mahkamah mengenakan beberapa syarat kepada Zambry namun meskipun peguam Zambry iaitu Dato' Cecil Abraham pada dasarnya bersetuju syarat dikenakan ke atas Zambry, Peguam Negara pula menentang syarat dikenakan ke atas Zambry.

Adalah jelas dan nyata sejak dari awal Peguam Negara iaitu Ghani Patail tidak pernah menunjukkan sikap neutral di dalam kes ini. Beliau sejak awal menunjukan sikap memihak kepada Zambry meskipun berselindung di sebalik topeng penjaga kepentingan awam. Sikap beliau dari awal menunjukkan beliau adalah penjaga kepentingan Umno.

Peguam Negara sejak awal bersungguh ingin mematikan kes Nizar. Beliaulah yang memohon merujuk kes ini ke Mahkamah Persekutuan di bawah seksyen 84 Akta Mahkamah Keadilan. Di Mahkamah Persekutuan beliau kalah dan kes Nizar masih hidup. Selepas itu beliau sekali lagi menentang bermati-matian agar Mahkamah tidak membenarkan Nizar meneruskan permohonan semakan kehakiman dengan alasan kononnya Nizar mencabar kuasa Sultan Perak.

Sekali lagi , Mahkamah tolak hujah beliau dan kes Nizar diteruskan. Semasa kes Nizar berjalan, beliau sekali lagi berhujah dan memohon Mahkamah menolak permohonan semakan kehakiman ( judicial review ) Nizar.

Sekali lagi Mahkamah Tinggi menolak bulat-bulat keseluruhan hujah beliau. Tiada satu pun hujah Peguam Negara yang diterima oleh Yang Arif Hakim Mahkamah Tinggi.Akhirnya saya ingin jelaskan di sini perintah penggantungan pelaksanaan BUKAN perintah membatalkan keputusan Mahkamah Tinggi .

Keputusan Mahkamah Tinggi masih sah dan mengesahkan bahawa Nizar adalah Menteri Besar yang sah dan Zambry adalah Menteri Besar yang haram.

Oleh kerana menteri besar haram merayu mungkin Mahkamah rayuan berpendapat bagilah peluang menteri besar haram tersebut pegang jawatan tersebut sehingga rayuan beliau diputuskan sebab bukankah sejak dari awal beliau telah ketagih dan mabuk dengan kuasa sehingga sanggup membenarkan partinya merompak Kerajaan sah yang diterajui oleh Menteri Besar yang sah dan dipilih secara sah oleh rakyat Perak.

ZAmbry-Chief Clown of PErak Circus compares self to Mandela and Ghandi-Ji

Zambry Perak Buat lawak!

Once again, I find myself in a position to shoot fish in a barrel.

I’ll just be the latest to take a dig at Hee and her pepper spray.

Hee’s first story was that she was holding a key chain not pepper spray; this changed into one where she was holding up the pepper spray to ask if it belonged to someone else.

Now, even if these versions of events were true - and good golly it’s so obvious they aren’t - I wouldn’t try to pass them off as the truth. In politics, there are just some battles that are unwinnable.

Trying to persuade people of the above version of events with the existence of the picture below floating around (observe the thumb position) makes Hee look like an even bigger idiot than she regrettably already does (and that’s saying a lot).

The ‘fun and games’ don’t end there. Our friend Zambry seems to have taken to new heights of delusion.

I mean seriously. Did he imagine that there were some Umno ‘flers in some dark and secluded place who would go “Yeah, he really is like Gandhi and Mandela, our hero!!”

Name me a single blog - even a pro-BN one - who has sung any of Zambry’s praises at all, much less compared him to the heroes of our generation. Self praise, as we all know, is no praise.

The following barely even bears expounding, but since we are so starved for good cheer amidst the circus that BN has insisted on turning Perak into (more on that to come), let’s pause and think of the differences between Zambry and his self-proclaimed peers.

Mandela/Gandhi: Rose up against the powers that be to uphold principles.
Zambry: Is part of the powers that be, and usurped power while steadfastly refusing to show any principles whatsoever.


Mandela/Gandhi: Braved prison and stuck with their values no matter how terrible the repression.
Zambry: Went to prison, came out, then joined forces with the people who imprisoned him, abandoning the cause he went to jail for.

Mandela/Gandhi: Spent their lives fighting racists.
Zambry: Proud member of racist race-based party, appoints Hamidah “Pukul India dulu” Osman as part of his cabinet.

Mandela/Gandhi: Made South Africa and India symbols of hope and people’s power.
Zambry: Made Malaysia the laughing stock of the world.

Mandela/Gandhi: Stood up against the astounding might of the British Empire, and apartheid South Africa.
Zambry: Doesn’t dare to face elections.

If I think of more, I’ll add to the list.This latest statement of his only confirms that in the circus that Perak has become, Zambry is obviously the chief clown.

On a more serious note, BN has shown time and again that it has refused to accede to the one and only true solution to this crisis: fresh elections.

I have scoured pro-BN blogs, the newspapers, etc, and I cannot find a single answer to the one question: Why?Why?Why?!
