Former Bar Council President - Not Another Anwar Prosecution!

We cannot afford another Anwar Prosecution

THE Datuk Seri Anwar Ibrahim prosecution is seen by many as the political persecution of the leader of the opposition. The question is, can we, as a nation, go through a second Anwar prosecution?

Lawyer Tommy Thomas had this to say in an article titled A Second Prosecution of Anwar Ibrahim — Is it in the national interest?: "The starting point is the previous prosecution of Anwar for sodomy in 1998[,] which imposed incredible strains on our legal system, and made Malaysia the laughing stock in the legal world.

"It would be sufficient to remind ourselves of the conduct of the prosecution in the 1998 case, the unfair publicity given by the mass media, the denial of bail, the 'irrelevant' rulings by the trial judge, the conduct of the trial itself, the amendment of the charges, the shameful parading of the mattress, the expungement of 'inconvenient' evidence, the finding of guilty, the lengthy sentence, the appeal to the Court of Appeal, and finally the appeal to the Federal Court."

I personally recall being utterly horrified and disgusted by the charges against Anwar the first time round. The initial charges carried wording I cannot repeat in good company. I also remember the terrible injustice done to Sukma Darmawan. And then to Dr Munawar Ahmad Anees, who to this day has not been vindicated by our courts although they have had the opportunity to do so. We must not forget these and other unfortunate people who all became innocent victims in this political war against Anwar.

The whole prosecution was a disgrace. I remember someone saying then that the trial robbed this country's citizens, in particular our children, of their innocence, as we had a daily fare of sodomy, semen-stained mattresses and the like.

Thomas argues, and I agree, that since those disgraceful events, the judiciary has taken steps to repair itself. He argues that a second prosecution would (I'd say could because, of course, the court could throw out the case) undo all the repair the judiciary has carried out to improve its image.

And it is no coincidence that Anwar is the opposition leader who has brought sweeping changes to the political landscape.
Tommy ThomasThomas argues: "If Anwar were not a potential prime minister, and only an ordinary citizen, he would not face this prosecution. It is as simple, plain and obvious as that."
The prosecution, Thomas argues, is economic and political suicide. He adds that the people of Malaysia are deeply divided on this issue, and that Malaysia's international image will, no doubt, suffer.

He then concludes with these words: "History is replete with examples of leaders who refused to learn from past mistakes, and were doomed to repeat them. It would be a tragedy of ancient Greek proportions if our leaders do not learn the lessons from 1998.

"It is abundantly clear that all the factors point in one direction: it is not in the public interest to subject the nation and its citizens to the trauma of a second trial..."

Ultimately, the powers-that-be must appreciate the consequences of this prosecution. If they win, they lose; if they lose, they lose. Actually, the nation loses. If you were a betting person, what would you do with those odds?

One thing must be made clear, it is my opinion that what we are doing to Anwar Ibrahim is starkly similar to what is happening to Aung San Suu Kyi. I ask, show me the difference between the two. I ask, how can we condemn the latter and do the former?

I call on the government to immediately review the Anwar prosecution in the public interest and because it is the right thing to do. If the government takes this step, it will certainly regain some credibility.

The AG's role
It is important in our justice system to appreciate the duties and responsibilities of the Attorney General, particularly in criminal prosecutions.

The Attorney General cannot act arbitrarily. In a judgment relating to the Attorney General's discretion over prosecutions, the Federal Court held that:

"The public of whose interest he [or she] is the guardian has a right to expect him [or her] to act honestly, without fear of powerful national and local figures or of the consequences to him [or her] personally or politically, and without favouring his [or her] relatives and friends and supporters, his [or her] principal concern being to maintain the rule of law so that there will be no anarchy and to maintain standards in public life and the private sector."

Aung San Suu Kyi (Public domain; source: Wiki commons) Our institutions must work to regain their credibility. I started my speech with a quote from Aung San Suu Kyi that fear of losing power corrupts those who wield it. I hope this is not what we are seeing today in Malaysia.

Rule of law
You would have appreciated by now that democracy, rule of law and human rights are all interlinked. The essential distinction between rule of law and rule by law must be noted.
Many dictatorships or military regimes can quite honestly say that everything that they do is in accordance with laws they have passed. Does our Internal Security Act, for example, accord with the rule of law? No — that is rule by law.

Laws passed by Parliament must accord with the rule of law. They must encompass basic fundamental liberties and values. These laws must be acceptable to a large number of people. They must be fair.

In Malaysia, even after 50 years of Merdeka, there are still in existence four declarations of emergency! We still have the archaic Sedition Act, Official Secrets Act, and Printing Presses and Publications Act. It is time for us to review all these pieces of legislation.

Within our borders
So, if there are human rights abuses outside our borders, can we in today's world fail to act? The answer is no. We must reach across our borders on issues of human rights.

But more important is what we do within our borders. Do we have the right to condemn apartheid, as we did, when we allow racist rhetoric to abound in our country? What about the right to condemn Aung San Suu Kyi's suffering while we treat Anwar Ibrahim the way we do? Can we criticise the kidnapping and disappearance of people overseas when it happens in our country?

We must have the moral authority to criticise others by ensuring we do not behave in the same way.

Menurut Naib Presiden PAS, Salahudin Ayub himpunan malam ini diadakan bertujuan menjelaskan pelbagai isu berhubung Pakatan Rakyat dan isu-isu semasa.

Najib....Najib... ADa yang Tak Kena?


Tuan Guru Nik Aziz - Dah Tiga Bulan Najib Jadi PM, Ada Yang Tidak Kena


“Kita telah masuk ke bulan ketiga sejak pelantikan Perdana Menteri yang baru. Kalau itulah ukuran sambutan orang terhadap Perdana Menteri yang baru maka sudah tentu ada sesuatu yang tidak kena.”

Demikian pandangan Mursyidul Am PAS, Tuan Guru Dato’ Nik Abdul Aziz Nik Mat dalam satu wawancara bersama Harakah baru-baru ini.

Menurutnya, ukuran Dato’ Seri Najib Tun Razak sebagai Perdana Menteri baru boleh dilihat berdasarkan sambutan masyarakat terhadapnya termasuk dunia luar.

“Dalam ukuran kepada populariti Perdana Menteri yang baru, kalau kita ambil daripada kaca mata “ucap tahniah” yang diterima oleh Malaysia, setakat ini yang saya diberi faham hanya Singapura, Brunei, dan baru-baru ini Amerika yang ucapkan tahniah. Hanya tiga pemimpin negara dari seluruh dunia yang menyampaikan ucapan tersebut.

“Kita telah masuk ke bulan ketiga sejak pelantikan Perdana Menteri yang baru. Kalau itulah ukuran sambutan orang terhadap perdana menteri yang baru maka sudah tentu ada sesuatu yang tidak kena,”jelasnya.

Tambah Nik Aziz, jika diselidik,sudah pasti pergolakan bukan sahaja dalam komponen Barisan Nasional (BN) malah isu dalaman Umno sendiri boleh dianggap sebagai punca pelantikan Najib sebagai Perdana Menteri tidak diterima dengan baik.

“Apa agaknya yang tidak kena, jelaslah pergolakan dalaman seperti isu PPP dengan elemen dua presiden antara Murugiah dengan Kayveas belum lagi selesai.

“Begitu juga dengan perpecahan di Terengganu antara blok Ahmad Said dengan Idris Jusoh, laporan ancaman bunuh ketika hendak hadir mesyuarat sidang dun masih belum selesai,”jelasnya lagi.

Nik Aziz juga menerangkan, bukan sahaja satu atau dua perkara tetapi ia juga melibatkan hampir seluruh negara seperti,”di Pulau Pinang sendiri pun, usul tidak terima kepada kepimpinan majlis perbandaran menolak salah satu. Itupun ia masih dalam keadaan yang hangat.

“Jika kita tinjau di Perlis, keadaan yang hampir serupa. Di wilayah ini, keadaannya sama, orang yang boleh diharap dalam menyokong Najib hanya dua, tiga orang sahaja. Mungkin dia bekas setiusaha politik dia, Zahid Hamidi dan mungkin seorang lagi yang baru dilantik sebagai Senator. Selain mereka, saya lihat masih berkecuali dan kemungkinan tidak memberi wala’ kepada Najib.”

Dalam pada itiu katanya, desakan oleh pemimpin DAP, Lim Kit Siang agar Najib diuji di parlimen untuk melihat wujud sokongan atau tidak juga antara indikasi bahawa kepimpinan Najib benar-benar bermasalah.

“Sebab itu desakan yang ditimbulkan oleh Lim Kit Siang berasaskan kepada 45 peratus sahaja undi popular yang diperolehi. Najib sepatutnya diuji dalam sidang dewan yakni ‘vote for non-confidence’.

“Kenapa ini tidak boleh dibuat? Ini perkara yang boleh dinilai tahap kekukuhan Umno buat masa sekarang ini,” tegasnya.

Zahid to Play a Meanigful Role in PKR

KUALA LUMPUR, June 15 — Maverick politician Datuk Zaid Ibrahim is determined to play a meaningful role in PKR and help make Pakatan Rakyat (PR) a strong alternative to Barisan Nasional (BN).

Zaid, who officially joined PKR on Saturday, said that he envisions a more democratic Malaysia where the people — and not the elites — would be in the driver's seat.

"I want people to have a choice," he told The Malaysian Insider today.

Zaid's membership is widely seen as a boost to PKR as some even perceive him to be prime minister material.

The former Kota Baru MP, however, denies having any ambitions to be prime minister. "I just want to do my bit," he says.

What he wants to do is help PR become more cohesive and hopes that the opposition coalition's three component parties, PKR, PAS and DAP will agree to the creation of a formal coalition secretariat as well as agree to share resources.

"The secretariat will try and find common positions on delicate issues and strengthen capacity building," Zaid said.

He said that he wants to play a role in the secretariat and his top priority would be to put in place a structure where the parties would have to meet regularly.

"I want to introduce a system so the parties can meet on a more formal basis and find common ground," he said.

Asked if he has any idea yet on how to handle "delicate issues" that may cause friction between the PR partners, Zaid replied that the coalition is still new and formed from diverse historical backgrounds.

"What is clear is that they have done well to stay together," said Zaid.

He shares that some questioned his decision to join PKR, a party which they perceive as weak, but he says that he sees in PR a huge opportunity.

"We cannot allow this country to go on like it has. Those in Umno keep harping on the past and justify their actions based on what happened many decades ago. But if you keep talking about the past when can we move forward?" he said.

"I hope more will join PR. Malaysians must believe they have a role to play. That is why I joined PKR."

Zaid had also toyed with the idea of joining PAS or DAP but in the end decided that as PKR was younger, he felt he could contribute more.

"The other parties are more mature. PKR is easier to change and the potential is a lot more," he said.

Kenyataan Media Yang Diedarkan pada 19 September 2007

Rakaman video ini melibatkan pejabat kehakiman tertinggi dalam konspirasi untuk mempengaruhi perjalanan sistem keadilan negara. Ia melibatkan campurtangan seorang peguam yang penuh dengan kontroversi dari sejarah penglibatannya dalam perkara yang menimbulkan syak wasangka dan seterusnya membawa kepada skandal yang melibatkan perlantikan hakim-hakim negara.

Pada tahun 1994, satu gambar menunjukkan VK Lingam dan Ketua Hakim Negara ketika itu Tun Eusoffe Chin cuti bersama di New Zealand dalam situasi yang melampaui tatasusila professional dan pengendalian yang tidak beretika Ketua Hakim tersebut. Lingam juga terlibat dalam laporan audit skandal Perwaja Steel oleh PriceWaterhouseCoopers yang dibentangkan di Parlimen yang melibatkan kerugian berbillion ringgit wang rakyat.

Dalam video ini, Lingam dirakam berbicara dengan Ketua Hakim Negara, Tun Ahmad Fairuz Abdul Halim di mana nama saya, antara lain, disebut secara khusus.

Perbicaraan tersebut adalah dalam konteks konspirasi untuk mempengaruhi lantikan hakim kanan dan campurtangan badan kehakiman. Oleh itu, kami mempunyai sebab kukuh dan percaya bahawa perbualan pada tahun 2002 ini menentukan hasil beberapa perbicaraan mahkamah penting, termasuk kes saya.

Video ini juga melibatkan Vincent Tan dan Tengku Adnan Tengku Mansor. Vincent Tan adalah seorang ahli perniagaan dan jutawan judi yang dikatakan terlibat mempengaruhi proses kehakimam dalam kes Ayer Molek. Tengku Adnan pula adalah pemimpin UMNO dan ahli kabinet yang terlibat dalam konspirasi politik untuk menjatuhkan saya pada tahun 1998.
Skandal video ini mengukuhkan dakwaan kami mengenai konspirasi politik yang melibatkan pemimpin tertinggi negara dan korupsi oleh ketua badan kehakiman. Ini membangkitkan isu mengenai hilangnya kesaksamaan perbicaraan mahkamah di negara ini. Perkara ini perlu disiasat segera demi kepentingan awam dan kami menggesa supaya satu Tribunal Bebas dibentuk segera untuk menyiasat hal yang amat memalukan ini.

Dalam hal ini, kami membuat rayuan khas kepada majlis raja-raja untuk memainkan peranan seperti yang termaktub dalam perlembagaan untuk membela hak rakyat dengan menggunakan pengaruh dalam hal-hal yang berada dalam bidang kuasa mereka.

Walaupun kisah "Rosmah Mansor" lebih sensasi di dalam Malaysia Today hari ni, teman lebih minat membicarakan kisah di bawah ini.

Ada kebenarannya dengan apa yang diperkatakan oleh RPK ini.

Dengan keghairahan berunity yang kembali terangsang di Selangor, segala2nya serba mungkin.

Lebih tepat lagi apabila RPK membicarakan tentang pegawai kerajaan yang belot kepada Kerajaan PR...

Apa tidaknya bro.? Di Ampang sendiri telah ada seolah2 musuh dalam selimut di kalangan penguasa (PBT) yang melarang peniaga2 kecil berniaga di Kubur Kosas. Ada yang telah mula di saman. Sengaja dibuat begitu...

Teman percaya Kerajaan PR tidak zalim dibandingkan dengan kerajaan terdahulu, tetapi ada trojan horse yang sengaja mengambil tindakan drastik yang sekaligus seolah2 memperlihatkan Kerajaan PR di Ampang rakus dan tidak berhati perut. Perkara ini sudah melata diperkatakan di seluruh Bukit Indah dan Ampang Indah.

Jika ini tidak diatasi segera, ditambah dengan Najib sebagai Pengerusi Perhubungan Negeri... macam2 boleh berlaku yob!!

2. Teman pernah ke JPS Selangor, di Bangunan State Secretary baru2 ini atas urusan pejabat. Terkejut teman tengok..ditampalnya di dinding pejabat...moto kerajaan Khir Toyo. Siap warna kuning lagi..Ada berapa tak berapa ingat teman..mungkin 10 perkara..muluk2 belak....muka si tempe tupun ada..?? Hmmm...masih sayang lagi demer kat mamat ni yer?

3. State Secretary tu orang Umno biru karat yob. Teman tau sangat le...apa idaknye yob. Kalu tak silap teman pada tahun 2003 teman ada buat appointment jumpa dia pasal Bukit Indah... dah buat appointment..tak ade pulak dia pada hari yang ditetapkan. Ke mana agak2nya ye?
Ke Temerloh yob...masa tu ada wakil rakyat mati kat sana. Dia gi kempen untuk Umno. Bayangkan yob...dia tu masa tu YDP Ampang Jaya...gi kempen kat Temerloh utk Umno...apa barang?? Kuat tak kuat Umno mamat ni...??

La ni dia State Secretary. Nego dengan kerajaan pusat pasal Syabaspun dia yang head utk kerajaan negeri... Boleh pakai ke yob? Tak tahulah kalau la ni dia dah taubat lahom...(ikut kata Mat Sabu)..??

Jadi sendiri mau ingatlah yer bro..!!

Kenyataan ini saya edarkan setelah berbincang dengan Ustaz Abdul Hadi Awang dan Sdr. Lim Kit Siang semalam. Kami mengulangi komitmen untuk memperkukuhkan kerjasama Pakatan Rakyat bagi menjayakan Agenda Perubahan. Kami berpendapat adalah penting untuk memberi peluang dan ruang kepada rakan-rakan parti komponen untuk menjelaskan pendirian mereka berhubung sebarang isu yang berbangkit. Kami percaya perselisihan kecil yang digembar gembur oleh media umno-bn tidak akan meretakkan permuafakatan yang terbina dari iltizam untuk membawa Perubahan kepada rakyat Malaysia keseluruhannya.

Perlu dijelaskan bahawa isu rundingan PAS-umno yang berbangkit dari kenyataan Ustaz Abdul Hadi pada sidang akhbar selepas menyampaikan ucapan dasar di muktamar tahunan baru-baru ini harus dilihat dalam konteks pidato Presiden Pas. Dalam pidato tersebut Ustaz Abdul Hadi mengulangi komitmen PAS untuk memastikan Perubahan terlaksana melalui wadah Pakatan Rakyat dan menggariskan kewajaran muafakat antara parti bagi menyelesaikan krisis Perak melalui pilihanraya, menggesa agar badan kehakiman bebas dari sebarang kongkongan dan pilihanraya yang telus.

Inshaallah permuafakatan Keadilan, PAS dan DAP akan bertambah utuh dari hari ke hari. Rakyat Malaysia mahukan sebuah kerajaan yang bertanggungjawab, telus dan cekap mentadbir bagi kembali memacu negara ini ke persada. Pakatan Rakyat bersedia menggalas tanggungjawab demi memastikan negara ini berada di landasan yang tepat.

Kenyataan Presiden DSWA berhubung Kerajaan Perpaduan

KENYATAAN MEDIA UNTUK EDARAN SEGERA—

Saya bagi pihak Parti Keadilan Rakyat (KeADILan) merakamkan ucapan tahniah kepada Parti Islam SeMalaysia (PAS) kerana berjaya melangsungkan muktamar tahunan kali yang ke-55 di Shah Alam baru-baru ini. Syabas juga saya ucapkan kepada barisan pimpinan PAS yang baru sahaja terpilih di dalam muktamar tersebut.

Muktamar PAS tahun ini menyaksikan isu kerajaan perpaduan menjadi perhatian umum. Pelbagai spekulasi dan andaian telah dibuat oleh pihak-pihak tertentu berikutan dari ucapan dasar Presiden PAS.

KeADILan berpendirian adalah sebaiknya untuk kami menunggu penjelasan dari pimpinan PAS berhubung isu kerajaan perpaduan mahupun sebarang bentuk perbincangan dengan Umno.
Sungguhpun begitu, kami tidak menghalang mahupun mempertikaikan hasrat mana-mana pihak untuk berbincang isu-isu yang membabitkan kepentingan nasional.

Saya mengambil kesempatan ini untuk mengulangi komitmen KeADILan untuk memastikan Pakatan Rakyat sentiasa berada di dalam keadaan kuat dan utuh. Kami yakin rakan-rakan kami, PAS dan DAP juga mempunyai iltizam yang sama demi memastikan agenda perubahan terlaksana di Malaysia.

Selangor Mahu Exco dalam Port Klang Authority

Selangor wants EXCO Member on PKA Board

The Selangor government plans to place a state executive councillor on the board of directors of the Port Klang Authority (PKA) to monitor developments in the Port Klang Free Zone (PKFZ) issue.

Mentri Besar Tan Sri Abdul Khalid Ibrahim said the state government had the right to do so as one seat in the PKA board was allocated to a state government representative.

“The State EPU (Economic Planning Unit) director Datuk Noordin Sulaiman previously occupied the seat but his term expired two months ago. So, we will appoint an executive council (exco) member to the board.

“This is for us to know about the developments in the PKFZ as well as the problems and overall development in Port Klang,” he told reporters after officiating at a programme to improve Tamil school education in Selangor, here, today.

Khalid said the state government supported the establishment of the PKFZ as it could enhance international trade in the state.

He said besides that, it would also encourage the setting up of more tax-free industrial plants, hence providing more employment opportunities.

“It will also spur the development of certain industries such as the halal food industry in the area,” he added.

Asked whether the state government planned to take over the management of the PKFZ following the controversy over the implementation of the project, Abdul Khalid said: “The state government can take over provided the federal government can write off the excess development cost.”

The PKFZ which belongs to PKA and is built next to Westports in Pulau Indah, Port Klang, is meant to be a regional export hub with manufacturing activities complemented by amenities to facilitate the growth of regional distribution centres or international procurement centres.

The federal government had ordered a full investigation into the PKFZ controversy, in which the original projected cost of RM1.85 billion ballooned to RM4.6 billion amid allegations of irregularities, while the occupancy rate is low, making the integrated zone a white elephant.

Corruption and Competitiveness cannot co-exist - Tunku Aziz
Malaysia is replete with laws. You name them, and we have them. What we do not have, we produce them instantly, well, almost, in our Barisan Nasional-dominated Parliament where MPs are not encouraged to study and discuss Bills being tabled too carefully.

We also, it is claimed, have the best legal framework, rules, regulations and procedures. And we also have the Malaysian Anti-Corruption Commission, Tun Abdullah Ahmad Badawi’s afterthought farewell gift to a nation that has had to put up with decades of unbridled government corruption.

In the nature of things, it is not polite to look a gift horse in the mouth. Unlike Midas who turned everything he touched into gold, Pak Lah turned most things he touched into base metal. The MACC is a prime example of the Abdullah touch.

Even with the MACC and its new-found “independence”, we remain a thoroughly corrupt country where corruption is unofficially tolerated, and no one particularly wants to know how instant wealth is acquired. In a society such as ours where money, however obtained, is worshipped and a person with money is revered, it is not surprising that unethical public behaviour has become the norm in the corridors of power.

You do not need to take my word for it: independent international surveys, year in and year out, arrive at the same conclusion. Malaysia lags far behind Singapore, Hong Kong, Japan, Taiwan and Korea. When compared with Singapore or even Hong Kong, we are inferior on every indicator. There is, I know, at least one government agency that has undertaken a survey of its own to show that foreign surveys are biased and, therefore, unreliable. Naturally, the results are enormously flattering, but Malaysians and the world at large are more savvy than Malaysian functionaries are prepared to concede.

We are, let us not forget, dealing with well-established, professional and highly respected international survey organisations that have no rhyme or reason to show Malaysia in a bad light. The degree of unanimity among all of them, year in and year out, is remarkable.

There appears to be an official obsession to have Malaysia held up as a shining example of a country that is to be admired for its good governance, to the point of wasting large sums of money on a massive exercise in self-deception to show what great universities we have in Malaysia.

Unfortunately, this obsessive desire for greatness is not matched by the application of appropriate policies to ensure Malaysia remains competitive in global terms.

If we lose our competitive position because we are corrupt and lack integrity, we are putting our future as a nation at risk. Corruption kills competition, breeds inefficiency, distorts our decision-making processes and promotes social and political instability in the long run.

I believe that in societies where integrity is firmly entrenched, such as Singapore and Hong Kong, corruption is kept firmly under control. Malaysia has become, under successive administrations, notably the Mahathir administration, a cosy and comfortable incubator of all that is corrupt and unethical in our society.

It is not at all surprising that what began as petty corruption limited to “duit kopi” has today developed into a growth industry. It has become systemic and years of co-existing with this most debilitating of the social diseases has dulled our conscience and sense of self-worth.

Fighting corruption is too important to be left to the care and tender mercies of any government agency, let alone the MACC whose record to date has left many of us wondering whether it is not another one of Abdullah’s sick creations . It is our fight, after all, and we should keep an eagle eye on the corruption front.

We in Malaysia operate in a corruption friendly environment where corrupt practices are becoming a way of life. Our public officials, rightly or wrongly, are perceived to be on the take. Every level of the civil service, including the police, has been touch by corruption. This is not saying that every police officer or district officer is corrupt. Most are honest, decent servants of the King.
Years of Mahathirism have, however, damaged many of our important institutions.
Corruption has weakened our capacity to enforce our laws, and there is evidence of this fact everywhere — from the thousands of illegal immigrants with false documents, Mykads and work permits who know that they can work their way out of trouble by the simple expedient of “buat selesai”. We have slowly but surely lost ground to lawlessness because people employed and entrusted to carry out their duties have allowed themselves to be seduced by easy money.

It is interesting to note that the government has shown, in important law and order and corruption issues, it has no stomach to confront them decisively. Just as it is true on the implementation of an Independent Police Complaints and Misconduct commission that Abdullah surrendered to police pressure without a whimper, it is also true that what would have been an effective legal provision to call people suspected of corruption to account for their ill-gotten wealth has been deliberately omitted. The reason is not far to seek. We would need more prison space.
It is argued that there is already a money laundering Act in the law, but that is a totally different kettle of fish, and the failure on the part of the government to incorporate this provision in our laws (that Singapore and Hong Kong consider essential and have in their arsenal) smells a little fishy. I wonder if our “People’s Prime Minister” has the political will to act against the corrupt in his administration

Malaysians say Politicians the most corrupt lot


KUALA LUMPUR, June 3 — We may have voted them into office but the truth of the matter is, we don't think very highly of our politicians.

Malaysians believe that politicians are the most corrupt group, according to a global survey by anti-graft body Transparency International (TI).

In the 2009 Global Corruption Barometer (GCB), 42 per cent of Malaysians said that political parties are the most corrupt institution, followed closely by the civil service at 37 per cent.

They are also not optimistic that graft will be curbed as two-thirds of Malaysians have no faith in the government's efforts to fight corruption.

TI Malaysia president Datuk Paul Low said that this was due to the fact that the public had no idea how political parties were funded.

"Corruption in politics is the mother of all corruption. Nobody knows how they are funded. They need to eliminate money politics as well as disclose their sources of funding," he said, adding that changes in electoral laws as well as compulsory audits would be needed to reverse public perception.

However, he felt that the results may not be accurate as the survey was conducted three months ago, amid speculation of monetary inducement that resulted in the Perak political crisis as well as vote-buying in the Umno party polls.

Low also called for better accessibility to information regarding government contracts and concession agreements as well as reviewing the Official Secrets Act as "these are not strategic interests" which could compromise national security.

Malaysia regularly scores close to five out of 10 on TI's Corruption Perception Index and last November's results left it ranked 47th out of 180 countries.

Despite the move to give further powers to the national anti-graft squad when it was converted from the Anti-Corruption Agency to the Malaysian Anti-Corruption Commission (MACC), 67 per cent of Malaysians still feel the government has been ineffective in dealing with corruption.

While Low said it was still too early to judge the MACC, he acknowledged public perception was that it practised selective prosecution and must instead "take the big fish along with the small fish." TI Malaysia would also attempt to conduct a public poll on its performance later this year.
Meanwhile, of Malaysians polled, only 9 per cent admitted to paying a bribe in the last 12 months, slightly below the global average of 13 per cent. Low noted that while three out of 10 Indonesians admitted to bribery, three-quarters felt their government has been effective in fighting graft.

"We can see that the Indonesian president has become more popular so it shows people value the intergrity of politicians," he said, referring to surveys showing Susilo Bambang Yudhoyono's popularity has increased ahead of this year's presidential elections.


Globally, political parties were considered by 29 per cent to be the most corrupt followed by the civil service at 26 per cent, while on average, 56 per cent felt their governments had not tackled graft well.

Also, respondents indicated an 8 per cent increase in the perception that the private sector is corrupt. Low said that companies should take heed to the fact that 50 per cent of Malaysians said they would prefer to purchase from "corruption-free" companies.

"The private sector should introduce anti-bribery and whistle-blowing policies as well as integrity agreements," he suggested.

He also said that while he was disappointed that Malaysia has not improved its corruption index for over eight years, he was encouraged by Prime Minister Datuk Seri Najib Razak's statements on graft so far as it was early days yet in his two-month-old administration.

Low said that TI Malaysia has been consulted by the government many times before and he would be submitting a copy of this year's GCB, its sixth edition and the first with Malaysian participation, to Najib and was hopeful of further discussions with the government on the matter.

Akan berlakukah Mega Telco Broadcaster?

Ananda's Mega Telco-Broadcaster (Maxis + Astro) vs UMNO's Media Prima-Telekom


It could be for some (sinister) reasons to have this news to circulate. It is a fact that all our media and telcos owned by UMNO and cronies as well as GLCs (Telekom - Celcom).

If Ananda's Maxis merges with Ananda's Astro, it is something not impossible. The combined asset worth would be RM20 billions. Bigger than some states. Even as per now, Maxis makes millions out of Astro's stupid Akademi Fantasia.

Not sure whether Media Prima would make its move....could be partnering with Telekom or buying another telco? Media Prima is the only RTM's competitor with 4 TV channels but as with Telekom has no pay TV and satellite.

However, MEASAT is also owned by Ananda.....
